Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of January 6, 2009, following the Public Meeting and Public Hearing of November 13, 2008, voted to approve the proposed work at the subject premises, as put forward in your application completed December 11, 2008. This approval will expire January 6, 2015. The proposed work, as approved, consists of the modifications to storefront openings, including the removal of two one-over-one, double-hung aluminum windows and one wood and glass door from the ground floor of the East 66th Street facade; and the installation of two single-paned fixed windows and a single metal and glass door within the existing masonry openings, featuring a dark bronze finish, and the installation of a plaque at the pier adjacent to the west of the entrance ("Stefano Canturi"); the installation of three fixed awnings, featuring black matte fabric, with white letters on the skirts within the three masonry openings on the East 66th Street façade ("Canturi"). The proposal, as originally presented, consisted of the removal and replacement of the entrance framing and transom. The proposal was shown in existing conditions photographs; color rendering of proposed storefront; and drawings labeled LPC.A through LPC.G, dated December 3, 2008, all prepared by James D'Auria Associates PC Architects, submitted as components of the application, and presented at the Public Meeting and Public Hearing. In reviewing this proposal, the Commission noted that the Upper East Side Historic District designation report states that 40 East 66th Street is neo-Gothic style studio building built in 1907-09; and that the building's style, scale, materials and details are among the features that contribute to the special architectural and historic character of the Upper East Side Historic District. With regard to this proposal, the Commission found that the removal of existing windows from openings at the ground floor of the East 66th Street elevation will not result in the loss of a significant amount of historic fabric; that the retention of the individual window openings and installation of a door will maintain the residential character of this side of the building; that the materials and finish of the proposed window will relate to other windows found at the upper stories of the building; that the proposed single-pane, fixed windows will reflect the commercial use at the first floor and give a uniform treatment of the first floor of the building; that the proposed sign will be well scaled to the building and will not call undue attention to itself; that the proposed awnings will not conceal any significant features; that the proposed awnings will recall awnings historically found on both residential and commercial windows in terms of material, shape, size and slope; and that the work will not detract from the special character of the Upper East Side Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that the perimeter frame and transom be retained and incorporated into the design; and a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on April 2, 2009, the Landmarks Preservation Commission received final drawings labeled A-100.01, A-200.01, A-201.01, A-300.01, A-400.01, dated revised April 7, 2009, prepared by James D'Auria, R.A., S-100.00, dated revised March 20, 2009, prepared by Andrew Burt Renfroe, P.E.. Accordingly, staff reviewed the drawings and found that the change requested by the Commission has been incorporated into the proposal; and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-8619 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
