Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of January 13, 2009, following the Public Hearing of September 9, 2008, and
the Public Meetings of September 16, 2008, and November 18, 2008, voted to approve a proposal to legalize the
construction of stair and elevator bulkheads in non-compliance with Certificate of No Effect 07-3284, as put
forward in your application completed on August 14, 2008.

The proposal as approved, consists of alterations at the penthouse roof, including the removal of the partially
constructed elevator bulkhead; the construction of an elevator machine room level with the height of the existing
stair bulkhead; the installation of a metal and glass railing at the front of the penthouse roof; and pushing the stair
bulkhead back 2'11" from the front edge of the penthouse. The proposal was shown on three unlabeled
presentation boards dated January 2009, prepared by Michael Gadaleta, R.A. The proposal, as initially presented
at the Public Hearing of September 9, 2008, included legalizing the stair and elevator bulkheads in their
non-compliant condition, and the installation of mechanical units at the roof of both bulkheads, as shown on
presentation documents dated September 2008.

In reviewing this proposal, the Commission noted that the Ladies' Mile Historic District designation report
describes 17 East 17th Street as an early twentieth century commercial style store and loft building designed by
George and Edward Blum, and built in 1911-1912; and that the building's style, scale, materials, and details are
among the features that contribute to the special architectural and historic character of the Ladies' Mile Historic
District. The Commission further noted that Certificate of No Effect 07-3284 (LPC 07-2164) was issued October
31, 2006, for the construction of a one-story rooftop addition; and that Warning Letter 08/1498 was issued June
25, 2008, for "work in non-compliance with LPC 07-2164 (CNE 08-3284) issued October 31, 2006."

With regard to this proposal, the Commission found that the construction of the rooftop addition did not cause
damage to any significant features; that the size of the addition and set back location do not overwhelm this large
loft building; that the rooftop addition is only visible from great distances from Union Square East and select
locations within Union Square and against the backdrop of other buildings; that the addition, though visible from
locations within Union Square, is seen in conjunction with other rooftop accretions on neighboring building; and
that the addition is finished in a neutral material that helps blend with the secondary façade of an adjacent taller
building. Based on these findings, the Commission determined the proposed work to be appropriate to the
Ladies' Mile Historic District and voted to approve it.

However, in voting to approve this proposal, the Commission required that two complete sets of signed and
sealed Department of Buildings filing drawings be submitted for review and approval by the staff of the
Commission. Subsequently, on April 3, 2009, the staff received drawings labeled A000, A100, A102 through
A109, A202, and A301 dated February 20, 2009, prepared by Michael J. Gadaleta, R.A., and drawings SP001,
SP100 through SP104, P001, P100 through P104, and P200 dated December 7, 2007, and M100 through M106
dated January 4, 2008, prepared by Paul L. Gallo, R.A. Staff reviewed these drawings and noted the inclusion of
the following additional work: the installation of a skylight, wood deck, spa, and glass railing at the rear of the
penthouse roof; the installation of four (4) HVAC condensing units and a skylight at the rear terrace at the
penthouse level; the installation of three (3) one-over-one lot line windows at the south elevation of the
penthouse; and the installation of one (1) lot line window at the north elevation of the penthouse; and interior
alterations at the second through seventh, and penthouse levels, including changes to non-bearing partition walls,
finishes, and plumbing, mechanical, electrical, and structural systems. With regard to these changes, the
Commission finds in accordance with the Rules of the City of New York, Title 63, Section 2-19, that the
proposed additions at the rear of the penthouse roof consist solely of mechanical equipment; that the installations
do not result in damage to, or demolition of, a significant architectural feature of the roof of the structure; that the
installations are not visible from a public thoroughfare; and that the installations do not adversely affect
significant architectural features of adjacent improvements. The Commission further finds in accordance with the
R.C.N.Y., Title 63, Section 2-15, that the proposed windows at the north and south secondary elevations do not
alter or destroy other protected features, nor does the proposed window openings or sash detract from such
protected features by their proximity to such features; and that the interior alterations will have no effect on
significant protected features of the building. Furthermore, the staff reviewed these drawings and determined that
the proposal approved by the Commission has been maintained. Based on this and the above findings, the
drawings have been marked approved by the Landmarks Preservation Commission with a perforated seal, and
this Certificate of Appropriateness is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
