Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of April 7, 2009, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed on March 12, 2009. The proposed work, as approved, consists of legalizing the replacement of the northernmost shopfront at the Madison Avenue facade without a Landmarks Preservation Commission permit and legalizing the replacement of the third northernmost shopfront at the Madison Avenue facade in noncompliance with Certificate of No Effect 08-8604. Both of the approved replacement shopfronts feature panels of glazing throughout the entire shopfronts; horizontal bands of metal framing at the top and the bottom of the shopfronts; white-painted spandrels, immediately behind the glazing and extending across the upper portion of the shopfronts; and white-painted piers at one end of each of the shopfronts and immediately behind the glazing. Additionally, the third northernmost shopfront also features a translucent coating at the glazing in front of a pier, set back approximately 4" from the glazing. The work was shown on six presentation boards, labeled 1-6, dated (presented) April 7, 2009, prepared by Brent Porter, RA, and consisting of drawings and photographs, and two boards, labeled 7 and 8, dated (presented) April 7, 2009, prepared by the Commission staff, and consisting of photographs and copies of drawings, all presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the Upper East Side Historic District Designation Report describes 753-759 Madison Avenue (aka 27-31 East 65th Street) as apartment building designed by Anthony M. Pavia and built in 1959. The Commission also noted that Certificate of No Effect 08-8604 (LPC 08-5631) was issued on April 3, 3008 for shopfront replacement and interior alterations; and that Warning Letters 09-0919 and 09-0920 were issued on February 24, 2009 for the "installation of 2nd southernmost storefront in non-compliance with LPC 08-5631 (CNE 08-8604) issued April 3, 2008" and the "replacement of northernmost storefront without permit(s)" respectively. With regard to this proposal, the Commission found that the building is not one of the buildings which contribute to the special architectural and historic character of the Upper East Side Historic District; that the removal of the previous existing shopfront infill has not eliminated any significant historic fabric; that the replacement infill maintains the streetwall and features large glazed areas in keeping with shopfront infill throughout the streetscape and historic district; that the consistency of the shopfront designs helps to unify the building base in keeping with the character of the historic district; and that the work does not diminish the special architectural and historic character of the Upper East Side Historic District. Based on these findings, the Commission determined the work to be appropriate to the building and the historic district and voted to approve the application. Additionally, the Commission received drawings A4.01 Section and A4.02 Section, dated August 2, 2007; and drawing A1Site Elev, dated January 2, 2009 and prepared by Brent M. Porter, RA. Accordingly, staff reviewed the drawings and noted that they schematically illustrate the approved completed work. Based on this and the above findings, the drawings have been marked approved with a perforated seal; Certificate of Appropriateness 09-8666 is being issued; and Warning Letters 09-0919 and 09-0920 are hereby rescinded. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
