Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of of October 21, 2008, following the Public Hearing of October 21, 2008, voted to approve the proposal for work at the subject premises, as put forth in your application completed on September 25, 2008, as you were informed in a Status Update Letter dated November 24, 2008. This approval expires October 21, 2014. The work, as approved, consisted of alterations at the front façade, including, at the ground floor, the removal of the existing modern metal-framed storefront and stone bulkhead panels, and the installation of a new painted wood storefront, with paneled bulkheads, transoms, signage painted on the wood signband, and a new painted sheet metal cornice, above the signband, with a concealed light trough; and, at the three upper floors, removing the existing modern one-over-one double-hung windows, and installing new two-over-two double-hung wood windows, and the in kind replacement of sheet metal lintel covers, all as shown in drawings all as shown in drawings LPC-00, LPC-01, LPC-03, PLC-04, LPC-07, and LPC-09, all dated September 18, 2008, and paint samples, Benjamin Moore "Sail Cloth" for the storefront and window frames, and Benjamin Moore "Annapolis Gray" for the doors and window sash, all prepared and presented at the Public Hearing and the Public Meeting by Li-Saltzman Architects, P. C. As originally calendared, the proposal included the construction of a visible stair bulkhead, which was deleted prior to the Public Hearing. In reviewing this proposal, the Commission noted that the Ladies Mile Historic District Designation Report describes 866 Broadway as Greek Revival style rowhouse built in 1847-48, and altered at the ground floor for commercial use in the 1850; and that Certificate of No Effect 99-0687 was issued on July 31, 1998, for the installation of new storefront infill. The Commission also notes that the storefront in place at the time of designation was a modern storefront; that the existing storefront is very simply detailed; and that the windows on the upper floors are in a deteriorated condition. With regard to this proposal, the Commission found that removing the modern storefront will not cause the destruction of any significant protected historic material; that the configuration and materials of the proposed ground floor infill, featuring painted paneled wood and glass doors, large display window with paneled wood bulkheads and transoms, and a signband, will recall the historic storefront found at buildings of this age and type in this historic district; that the proposed two-over-two wood windows will be consistent with the fenestration found on transitional buildings in this historic district; and that the proposed work will not diminish the special architectural and historic character of the building, the streetscape, or the Ladies' Mile Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the buildings, and voted to approve it. However, the Commission made its determination subject to the following condition: 1. that two sets of stamped and signed Department of Building construction drawings showing the approved design be submitted to the Commission for review. On February 19, 2009, the staff of the Commission received the requested drawings, A-000, A-001, D-100, D-200, A-100, A-200, A300, A301, A302, and A-400, all dated February 12, 2009, and specifications dated February 18, 2009, all prepared and submitted by Li-Saltzman Architects, P. C. Staff has reviewed these materials and finds that the proposal approved by the Commissioners has been maintained; and that the drawings include removing the painted finish from the front and rear facades, and the minimally detailed fire escape on the front facade, repointing; re-building small selected areas of the facade where the brick is missing or in a deteriorated condition; replacing the windows at the rear facade, and additional interior alterations, all conforming to Commission Rules. Based on this and the above findings, these drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 09-8631 is being issued. The approved work is limited to that described above. Please retain and clean samples of the historic brick and mortar removed during the facade cleaning, patching, and re-pointing, and, using them for color matching, prepare three sample patches showing the proposed new brick mortar, and notify the Commission to arrange for an inspection of the proposed materials to determine if the size, color, and texture of the brick, and the color, texture, and tooling of the mortar match the originals, prior to ordering materials or completing the final phases of the facade work. This permit is issued with the understanding that the masonry work on the exterior will take place when the temperature remains a constant 45 degrees Fahrenheit for 72 consecutive hours. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
