Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of September 9, 2008, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your
application completed on August 14, 2008. This permit will expire on September 9, 2014.


The proposed work, as approved, consists of constructing a metal clad rooftop addition, set back from the parapet
facades; installing rooftop mechanicals including bulkheads and railings; altering portions of the existing loading
dock by incorporating a ramp along the Washington Street façade. The work was shown on photomontages
within the streetscape, physical mockup on site, material samples, and drawings on presentation boards labeled 1
through 14, dated September 9, 2008, prepared by Morris Adjmi Architects, and presented at the Public Hearing
and Public Meeting.


In reviewing the application, the Commission noted that the Tribeca North Historic District designation report
describes 401-411 Washington Street (also known as 71-77 Laight Street), as a neo-Renaissance warehouse
building, designed by Maynicke & Franke and built in 1905-1906; and that the building's scale, style, materials,
and details are among the features that contribute to the special architectural and historic character of the Tribeca
North Historic District. The Commission finally noted that Certificate of No Effect 09-7209 was issued March
24, 2009 for restorative work, and that Modification of Use 09-8308 was issued March 24, 2009 approving a
request that the Landmarks Preservation Commission issue a report to City Planning Commission relating to an
Authorization for use pursuant to section 74-711 of the Zoning Resolution.
With regard to this proposal, the Commission found that the design of the infill at the base recalls the historic
warehouse loading bay doors, and is in keeping with the style, material and details of the building, and that the
finish will be based on an historic paint analysis; that the alterations to the modern loading dock to install two
ramps will maintain the presence of the historic loading dock, and allow barrier free access to the ground floor
entrances; and that the diamond plate covered stairs and metal railings will be harmonious with the materials of
the building and the historic district; that the addition of a light cove under the existing and proposed loading
dock canopies will be unobtrusive, and not detract from the utilitarian character of these elements; that the
proposed one-story rooftop addition will be set back from the street walls, and in terms of its simple design and
massing will be subordinate to the massing of the historic warehouse; and that the material, fenestration and
details of the one story rooftop addition will be in keeping with the character of the buildings façade and regular
fenestration pattern. Based on these findings, the Commission determined that the work is appropriate to the
building and to the historic district, and voted to approve this application.


However, in voting to grant this approval, the Commission made its determination subject to the stipulation that
the seventh story rooftop addition be modified in form to substantially reduce the visibility from the public
thoroughfare; to alter the color palette of the material for the rooftop addition cladding; and to modify the ramp at
the loading dock area, as well as send in two sets of final signed and sealed drawings, showing the approved
work, which are to be filed at the Department of Buildings, be submitted to the staff of the Commission for
review and approval.


Subsequently, on April 3, 2009, the staff of the Commission received a preliminary set of construction document
drawings labeled LPC1 through LPC7, S106.0.0, S107.0.0, LPC8, dated April 1, 2009, signed and sealed by
Morris Adjmi, R.A. Accordingly, staff reviewed the drawings and found that the proposal approved by the
Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with
a perforated seal, and this Certificate of Appropriateness is being issued.


PLEASE NOTE: This permit is issued contingent upon the Commission's review and approval of the final
material samples, paint selection, and any shop drawings for windows as well as final department of building
construction documents, prior to the commencement of the work. Please contact the Landmarks Preservation
Commission staff when they become available.


PLEASE ALSO NOTE: As the approved work consists of subsurface work, the applicant is required to strictly
adhere to the Department of Buildings TPPN 10/88 governing in-ground construction adjacent to historic
buildings. It is the applicant's obligation at the time of applying for their permit to inform the Department of
Buildings that the TPPN applies.


Any changes to the design required by the other city agencies including City Planning Commission, must be
submitted to the Landmarks Preservation Commission for review prior to any amendments being issued by the
Landmarks Preservation Commission.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to

this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
