Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of November 13, 2008, following the Public Hearing of the same date, and
the Public Hearing of October 21, 2008, (item read into the record only, not heard), voted to approve certain
alterations at the subject premises, as put forward in your application completed on October 16, 2008. The
approval will expire on November 13, 2014.


The work, as approved, consists of the removal of an existing aluminum double-hung window at the eighth floor
of a visible modern addition, set back 30 feet from the primary historic facade, and the installation of a larger
tri-partite window assembly with one-over-one double-hung metal windows and transoms, to match the existing
window assembly at the sixth floor. The work was shown on presentation boards consisting of existing condition
photographs, a site map, and drawings labeled C1.0 (dated 10/7/08); D1.0, A1.0, A2.0, and A3.2 (dated 7/7/08),
prepared by Chernerdesign LLC, and presented at the Public Hearing and Public Meeting.


In reviewing this proposal, the Commission noted that 644-46 Broadway is a Queen Anne/Romanesque Revival
style bank and loft building designed by Stephen D. Hatch and built in 1889-91; and that the building's style,
scale, materials and details contribute to the special architectural and historic character of the NoHo Historic
District.


With regard to this proposal, the Commission found that the installation of the new tri-partite aluminum window
will not damage or destroy any significant historic feature of the building; that the proposed window will be
located on a set-back façade that will only be visible from the street through a narrow corridor; that the new
tri-partite aluminum window at the eighth floor will match the existing tri-partite window at the 6th floor with
respect to size, material, operation and finish; and that a new tripartite window at the eighth floor will increase the
glazing area at the façade, which is more in keeping with the size and scale of windows in modern residential
additions. Based on these findings, the Commission determined the proposed work to be appropriate to the
building and the NoHo Historic District, and voted to approve the proposal.


The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two sets of signed and sealed Department of Building filing drawings showing the approved design.
Subsequently, on March 27, 2009, the Landmarks Preservation Commission received final drawings labeled C1.0
(dated "For Permit" 1/12/09); LPC.1 (dated "For Permit" 10/7/08); LPC.2, LPC.3, LPC.4, LPC.6, LPC.7, LPC.5,
M-1, SP-1 ( dated "For Permit" 7/7/08); A.1, A.2, A.3, A.4, A.5, A.6, A.7A.8, A.9, A.10 (dated "for Permit
9/7/08); and LPC.8, LPC.9, LPC.10, and LPC.11 (dated "For Permit" 3/7/09); all prepared by Benjamin Cherner,
R.A.


Accordingly, staff reviewed the drawings and found that the proposal has been modified to include window
replacement at the eighth floor, including installation of one new arch-headed one-over-one double-hung wood
window at the Bleecker Street elevation, in an opening that is currently boarded up; installation of one new
one-over-one double-hung wood window in a boarded-up window opening at the secondary eastern return
facade; and installation of one new one-over-one double-hung wood window at a regularized location at the
secondary eastern return facade, with all windows to be painted Benjamin Moore's "Chestnut" to match the
existing; and installation of a new flue at the roof. With regard to this additional work, the Commission finds, in
accordance with the RCNY Title 63, Section 3-04, that the new window at the primary façade will match the
existing historic arch-headed windows at the eighth floor in terms of configuration, operation, details, material,
and finish; and that the new one-over-one double-hung window will be installed in an existing window opening;
and that the window will match the predominant window configuration and finish at the eastern secondary return
facade. The Commission also finds, in accordance with the RCNY, Title 63, Section 2-15, that the new
one-over-one wood window at the secondary east return elevation will match the predominant window
configuration with respect to size, configuration and finish; that the location of the window will be regular and
consistent with the fenestration pattern at this facade; and that the installation of the new window will not damage
or destroy any significant features of the building. Furthermore, the Commission finds, in accordance with the
R.C.N.Y. Title 63, Section 2-19 (e), that installation of the new flue will be only minimally visible from a public
thoroughfare; that the installation of the new unit will not result in damage to, or demolition of, any significant
architectural features of the building; and that the new flue will not adversely affect significant architectural
features of adjacent improvements. Finally, the Commission also finds that the proposal approved by the
Commission has been maintained. Based on the above findings, the drawings have been marked approved with a
perforated seal, and Certificate of Appropriateness 09-6077 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
