Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 17, 2009, following the Public Hearing of the same date, voted to approve certain work at the subject premises, as put forward in your application completed February 19, 2009. This approval will expire March 17, 2015. The proposed work, as approved, consists of the removal of the non-historic storefront infill; and the installation of a wood and glass storefront, featuring operable wood and glass paneled doors, display windows with paneled bulkheads flanking a setback entrance with a paneled wood and glass door and sidelight, and a black painted finish (Benjamin Moore #2128-10 "Black Beauty"); and the installation of a wood signband above the storefront infill with flat pin-mounted metal letters reading "Patty & Bun"; as shown in photographs, historic tax photographs, a paint sample, existing and proposed floor plans, proposed elevations, sections, and detail drawings, and renderings, all prepared by Kenneth Philogene, and submitted as components of the application, and presented at the Public Meeting and Public Hearing. In reviewing this proposal, the Commission noted that the Greenwich Village Historic District designation report describes 61 West 8th Street as a rowhouse built in 1839, and altered in the late 19th and 20th centuries; and that the building's style, scale, materials, and details are among the features that contribute to the special architectural and historic character of the Greenwich Village Historic District. The Commission also notes that Notice of Violation 90-0471, was issued April 2, 1990, for "ongoing alterations to façade at first floor shopfront, West 9th Street facade, without permit(s)"; Notice of Violation 91-0342, was issued November 29, 1990, for "installation of fixed awning and sidewalk enclosure at West 9th Street facade without permit(s)"; and Notice of Violation 96-0550, was issued May 31, 1996, for "installation of exterior roll-down security gate at 64 West 9th Street without permit(s)". With regard to this proposal, the Commission found that the removal of the existing non-historic storefront infill will not result in the destruction of any significant features of the building; that the configuration of the proposed painted wood and glass storefront infill, including operable doors with paneled bulkheads and large display windows, flanking a recessed wood and glass door, will recall the historic storefronts on buildings of this age and type in this historic district; that the operable doors will feature paneled bases, thereby recalling the proportions of a traditional storefront with bulkheads when closed; that the fixed wood framing members between the doors will maintain a solid presence at the streetwall when the doors are open; that the size, placement, and simple design of the proposed flat panel wooden sign with pin-mounted metal letters is well-scaled to the storefront and will not detract from any significant architectural features; and that the proposed work will enhance the special architectural and historic character of the building and the Greenwich Village Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Greenwich Village Historic District, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that the applicant modify the depth details of the millwork; and that two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on April 21, 2009, the Landmarks Preservation Commission received final drawings labeled A-001.00 and A-101.00, dated issued April 14, 2009, prepared by Kenneth Philogene, P.E. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-9007 (LPC 09-6737) is being issued. PLEASE NOTE: That Notices of Violation 90-0471, 91-0342, and 96-0550 remain in force against the property. Failure to address these violations may result in the issuance of Notices of Violation originating from the Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7-02(c). These NOVs would require a court appearance and a civil penalty may be imposed. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
