Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of December 9, 2008, following the Public Hearing and Public Meeting of November 13, 2008, voted to approve a proposal to construct rear yard and rooftop additions, as put forward in your application completed on October 16, 2008, and as you were notified in the Status Update Letter issued on December 9, 2008 (SUL 09-5951, LPC 08-6374). This approval will expire on December 9, 2014. The proposed work, as approved, consists of the construction of a two-story, wood-and-glass rear yard addition, with a deck and stair leading to the rear yard, and a spiral stair leading to the cellar; the construction of a one-story rooftop addition, with a stucco finish; and the extension of the existing chimneys at the roof to meet building code requirements; as shown on presentation boards LPC-0, LPC-1, LPC-2, LPC-3, LPC-4, LPC-5, LPC-6, and LPC-7, dated September 2008, LPC-8, LPC-9, LPC-10, LPC-11, and LPC-12, dated November 2008, prepared by James Baer, submitted as components of the application, and presented at the November 13, 2008 Public Hearing, and presentation boards LPC-13 and LPC-14, dated December 2008, prepared by James Baer, submitted as components of the application, and presented at the December 9, 2008 Public Meeting. In reviewing this proposal, the Commission noted that the Clinton Hill Historic District designation report describes 115 St. James Place as an Italianate style rowhouse built c. 1865; and that the building's style, scale, materials, and details contribute to the special architectural and historic character of the Clinton Hill Historic District. The Commission also noted that Notice of Violation 96-0443 was issued on April 2, 1996, for "Installation of group mailbox without permit(s)"; that Notice of Violation 06-0351 was issued on February 28, 2006, for "Installation of security grilles at windows and door and installation of light fixtures and intercom without permit(s)"; and that Notice of Violation 06-0352, was issued on March 13, 2006, for "Replacement of door without permit(s). The Commission further noted that a non-historic single door and frame were present at the time of designation, and that no historic documentation exists of the original doors. With regard to the proposal, the Commission found that the roof and the rear of the building have no significant architectural features which would be lost or damaged as a result of the construction of the rooftop addition; that the addition will not be visible over the front façade, and will only be minimally and seasonally visible across the neighboring rear yards from Greene Avenue, over the rear of the building; that the proposed rooftop addition will be set back from the rear façade and will not obscure the original volume of the building; that the modest size of the addition on this building will not overwhelm this building or its neighbors; that the extended chimneys will be visible over the front and will be in keeping with the size and visibility of other chimneys within the row and historic district; that the material, fenestration and details of the addition will be in keeping with the character of the rowhouse and of other rooftop additions within the Clinton Hill Historic District; that the proposed rear yard addition will only be minimally and seasonally visible across the neighboring rear yards from Greene Avenue; that the addition will not rise to the full height of the building, and that the plane of the upper two floors of the rear facade will be retained, thereby maintaining the scale of the rowhouse and its relationship to other houses in the row; that the proposed rear yard addition will not extend to the rear lot line or substantially eliminate the presence of a rear yard; that other rear yard incursions exist on other houses on the block, and, therefore, the addition will not overwhelm the adjacent buildings or central greenspace; and that the proposed work will not diminish the special character of the building or the greenspace in the center of the block. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Historic District, and voted to approve it. The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review, and approval of final signed and sealed Department of Buildings filing drawings for the approved work. Subsequently, on March 17, 2009, the Landmarks Preservation Commission received final drawings A-1.1, A-1.2, A-1.3, A-1.4, A-2.1, A-2.2, A-2.3, A-3.1, A-3.2, A-3.3, A-3.4, A-4.1, A-5.1, and A-6.1, dated February 2009, prepared by Bernard J. Doyle, R.A. Staff reviewed these drawings and found that the approved work has been maintained. In addition, staff noted the inclusion of the following additional work: interior alterations at the cellar, basement, first, second, and third floors; the installation of four new AC units on new steel dunnage at the roof; exterior work at the rear façade, including the removal of five one-over-one double-hung wood windows, and their replacement with five one-over-one double-hung aluminum windows; the removal of a door at the basement, and its replacement with a one-over-one double-hung aluminum window in a modified masonry opening; the removal of a one-over-one double-hung aluminum window with transom at the first floor, and its replacement with masonry infill and a new one-over-one double-hung aluminum window; the removal of a one-over-one double-hung wood window at the second floor, and its replacement with a door to the deck on the roof of the new addition within a modified window opening; all new windows to be painted white; and exterior work at the front façade, including the removal of the metal gate at the front entrance, and the metal window guards at the first floor; the removal of the group mailbox at the areaway; the removal of the intercom at the front entrance; the replacement of two light fixtures at the front entrance; the legalization of the new front entrance doors, installed without Landmarks Preservation Commission permits; and repairing the wood cornice, and repainting the cornice black. With regard to the additional work, the Commission finds, in accordance with the Rules of the City of New York, Title 63, Section 3-04(d)(2), that the new windows and doors at the rear façade will not be visible from a public thoroughfare; that they will be installed in existing window openings, existing openings that are to be enlarged in height, and existing openings that are to be reduced in height; and that they will not replace "special" windows as defined in the definitions (section 3-01) and illustrated in Appendix A. The Commission also finds that the removal of the metal gate at the entrance, metal window guards at the first floor windows, group mailbox at the areaway, and intercom at the entrance, will not eliminate any historic fabric and will remove clutter from the façade. The Commission further finds that the installation of new light fixtures will not result in damage to any significant features; that the light fixtures will be installed on flat masonry; that they will be installed in a location that corresponds to the building entrance; and that will be of a simple design, small size and neutral finish and will not detract from the significant architectural features of the building. The Commission further finds, in accordance with the R.C.N.Y., Title 63, Section 3-04(c)(2), that the new doors at the front entrance closely approximate the historic doors in terms of configuration, operation, details, materials, and finish. The PAGE 2 Issued: 4/21/09 DOCKET: 09-8420 Commission finally finds that repairing and repainting the cornice will aid in the long-term preservation of this significant feature of the building. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-9009 is being issued. Please note that Notice of Violation 06-0352, issued on March 13, 2006, for "Replacement of door without permit(s)" is hereby rescinded with the issuance of this permit. PLEASE NOTE THAT THIS PERMIT CONTAINS A COMPLIANCE DATE OF DECEMBER 21, 2009 FOR THE CORRECTIVE WORK. If you do not complete the work by this date, a Notice of Violation (NOV) originating from the Environmental Control Board may be issued in accordance with Title 63 of the Rules of the City of New York, Section 7-02(c). This NOV would require a court appearance and a civil penalty may be imposed. Please note that Notices of Violation 96-0443 and 06-0351 remain in force against the property until the work approved under this permit is completed and inspected for compliance. Please submit photographs of the completed work to the Commission along with a letter from the building owner requesting a Notice of Compliance. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
