Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of April 7, 2009 following the Public Hearing of the same date, voted to grant
a Certificate of Appropriateness to install storefront infill at the ground floor, as put forward in your application
completed March 12, 2009, as you were informed in Status Update Letter 09-8649 (LPC 09-5877) issued April 7,
2009. The approval will expire April 7, 2014

The proposed work, as approved, consist of removing modern storefront infill from the ground floor and
installing a painted dark gray (Benjamin Moore "Black Panther" 2125-10) wood framed storefront consisting of
two display windows with paneled bulkheads and operable transoms flanking a recessed glass and wood entrance
door with a operable transom; installing a historically replicated wooden cornice above the storefront; installing a
retractable gray (Sunbrella "Slate") canvas awning with a scalloped skirt with the restaurant's name written on the
skirt; removing paint from existing brownstone piers and repairing the sandstone with a tinted cementicious mix;
and removing a modern residential entrance door and installing single leaf wooden door; as shown in historic
photographs, existing condition photographs, and drawings labeled A0.50, A0.51, and A0.52, dated March 11,
2009, prepared by Lily Lim, and submitted as components of the application and presented at the Public Hearing.

In reviewing this proposal, the Commission noted that the Chelsea Historic District designation report describes
156 9th Avenue as a vernacular style rowhouse with a ground floor storefront built in 1852; and that the
building's style, scale and details contribute to the special architectural and historic character of the Chelsea
Historic District. The Commission also notes that Warning Letter 09-0598 for "replacement of windows without
permit(s)"; Warning Letter 09-0599 for "replacement of door at residential entry without permit(s)"; Warning
Letter 09-0600 for "replacement of door at residential entry without permit(s); and Warning Letter 09-0601 for
"installation of mail drop box and intercom/buzzer panel at residential entry without permit(s)" were all issued
against the building October 28, 2008.
With regard to the proposal, the Commission found that the removal of the existing storefront and signage will
not eliminate significant historic fabric and will remove features that detract from the façade; that the
configuration of the proposed storefront, featuring two large display windows with wood bulkheads and operable
transoms flanking a recessed entrance door, is in keeping with historic storefronts found in the row and in
buildings of this age and type in the historic district; that the dark gray painted finish will recall painted finishes
historically found on wood storefronts in this historic district; that the proposed gray colored canvas awning will
recall historic retractable awnings in terms of the size, shape, slope and material; and that lettering on the
unframed awning skirt and painted on the display windows will recall historic signage found within the district
and will not overwhelm or detract from the significant features of the building. Based on these findings, the
Commission determined the proposed work to be appropriate to the building and the historic district, and voted to
approve it.

However, in voting to grant the approval, the Commission stipulated that the applicant expose and repair the
existing brownstone piers at the ground floor, and that a reduced copy of the proposal and two sign and sealed
copies of the final Department of Buildings filing drawings be submitted to the staff of the Commission for
review and approval

Subsequently, on April 16, 2009 the Landmarks Preservation Commission received final drawings dated April
16, 2009, labeled A-001, A-050, A-051, A-052, and A-053, and prepared by Mateo Paiva, R.A. Staff reviewed
the drawings and found that the work approved by the Commission has been maintained. Based on the above
findings, the drawings are marked approved, and Certificate of Appropriateness 09-8969 is being issued.

Please be advised that Landmarks Preservation Commission Warning Violations 09-0599 and Warning Letter
09-0600 remain in effect against the property until the approved work is completed in compliance with this
permit, and photographs of the completed work are submitted to the Landmarks Preservation Commission along
with a written request for a Notice of Compliance.

Please note that Warning Letter 09-0598 for "replacement of windows without permit(s)" and Warning Letter
09-0601 for "installation of mail drop box and intercom/buzzer panel at residential entry without permit(s)" both
issued October 28, 2008 are not addressed by this permit and remains in force against the property. Failure to
address these violations will result in the issuance of a Notice of Violation originating from the Environmental
Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7-02(c). The following
NOVs would require a court appearance, and a civil penalty may be imposed.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
