Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of February 3, 2009, following the Public Meeting and Public Hearing of the
same date, voted to approve the proposed work at the subject premises, as put forward in your application
completed January 8, 2009. This approval will expire March 4, 2014.

The proposed work, as approved, consists of the construction of a stair bulkhead set back from the Hudson
Avenue and rear elevations; the installation of a wood terrace and railing at the roof. The proposal was shown in
existing conditions photographs; drawings of proposed rooftop bulkhead; undated plan, elevation and section
drawings, which were submitted by Michael Gallagher as components of the application, and presented at the
Public Meeting and Public Hearing.

In reviewing this proposal, the Commission notes that the designation report describes 72 as an Italianate style
rowhouse built circa 1869-1876; and that the building's style, scale, materials and details are among the features
that contribute to the special architectural and historic character of the Vinegar Hill Historic District.

With regard to this proposal, the Commission finds that construction of the proposed bulkhead will not eliminate,
or cause damage to, any significant architectural features of the building; that the proposed bulkhead will not be
visible over the primary facade; and that the proposed bulkhead will be set back from the front and rear facades of
the building and will allow the historic massing of the building to be maintained. Based on these findings, the
Commission determined the proposed work to be appropriate, and voted to approve it.

However, in voting to grant this approval, the Commission stipulated that the height be further reduced and the
material be changed from masonry to standing seam or stucco and that a set of unmounted copies of the
presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for
the approved work be submitted to the staff of the Commission for review and approval.

Subsequently, on April 2, 2009, the Landmarks Preservation Commission received final drawings labeled 1
through 3, prepared by Scott Schnall, P.E. Accordingly, staff reviewed the drawings and found that the proposal
has been amended to reduce the height of the bulkhead to 7' 8", and the cladding material has been changed to
stucco. The Commission reviewed the drawings and found that the bulkhead will be less visible from Hudson
Avenue, Evans and Water Streets; and that the proposed stucco siding is in keeping with the character of typical
utilitarian rooftop accretions. Based on this and the above findings, the drawings are marked approved with a
perforated seal, and Certificate of Appropriateness 09-8552 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
