Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of January 20, 2009 following the Public Hearing of the same date, voted to
approve window replacement at the subject premises, as put forward in your application completed December 23,
2009. This approval will expire January 20, 2015.

The proposed work, as approved, consists of removing the tripartite aluminum windows featuring a one-over-one,
double-hung window flanked by fixed single-pane windows from within the arcade openings on all elevations;
removing the paired glass and metal doors, sidelights, transom, and brick infill from one arcade opening and
modifying an adjacent arcade window opening by removing the tripartite window configuration and brick infill,
all on the east elevation; and installing paired glass and steel doors, sidelights, and transoms; removing and
replacing a steel door, sidelight, and arched transom at the 23rd floor on the east elevation, with all the new steel
fenestration infill featuring a dark brown finish; as shown in the presentation boards, showing a block plan, a tax
map, historic photographs, existing condition photographs, color renderings, existing and proposed elevations,
horizontal sections, and vertical sections labeled A000, A301, A302, A303, A304, A603, A604, A605, A606,
A607, A609, A901, and A904, and dated January 8, 2009, and submitted as components of the application, and
presented at the Public Meeting and Public Hearing.

In reviewing this proposal, the Commission noted that the designation report for the American Tract Society
Building describes 150 Nassau Street as a steel skeletal-frame skyscaper with Romanesque and Renaissance
Revival-style elements built in 1894-95 and designed by Robert Henderson Robertson. The Commission also
notes that Certificate of Appropriateness 01-6936 (LPC 01-7015) was issued May 22, 2001 for installing new
glazing within the arcade at the rooftop tower, aluminum windows building wide, mechanical equipment at the
roof and interior courtyard, a vehicular entrance on Spruce Street, and new storefront infill and entrances; and
Miscellaneous/Amendment 04-3189 (LPC 03-5990) was issued November 14, 2003 for revising the details of the
windows at the tower arcade and the 2nd floor window above the building entrance.

With regard to this proposal, the Commission found that the removal of the existing, Commission approved
tripartite aluminum windows, will not result in damage to, or demolition of, significant architectural features of
the building; that the proposed tripartite steel windows featuring a fixed window flanked by casement windows
will have a more transparent appearance, and will better recall the original open arches of the tower arcade; that
the new glazing and framing will be installed directly behind the arched masonry openings, furthering the
transparency of the arches; that the proposed finish of the steel windows will match the painted finish of the
existing windows throughout the building; that the two arched openings on the east elevation to be modified to
accommodate paired steel and glass doors with sidelights will only be minimally visible from select vantage
points at a great distance; that the proposed modification to these openings will be limited to the plain masonry
below the openings and therefore, will not eliminated any significant historic fabric; and that the proposed work
will not diminish the special architectural and historic character of this Individual Landmark. Based on these
findings, the Commission determined the proposed work to be appropriate to this Individual Landmark, and voted
to approve it.

Subsequently, on April 13, 2009, the Landmarks Preservation Commission received final drawings labeled A301
and A904, dated issued December 23, 2008; and drawings labeled A302, A303, A304, A305, A603, A604, A605,
A606, A607, and A901, dated issued January 8, 2009, all prepared by David Baier Hotson, R.A. Accordingly,
staff reviewed the drawings and found that the proposal approved by the Commission has been maintained.
Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of
Appropriateness 09-8806 (LPC 09-8337) is being issued.

The Commission further notes that Warning Letter 00-0142, for the "replacement of southern-most Nassau Street
shopfront without permits," was issued August 30, 1999. Failure to address this violation may result in the
issuance of a Notice of Violation originating from the Environmental Control Board in accordance with Title 63
of the Rules of the City of New York, Section 7-02(c) . Second NOVs require a court appearance and a civil fine
may be imposed.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
