Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of October 14, 2008, following the Public Hearing of the July 22, 2008, voted to approve a proposal for work at the subject premises, as put forward in your application completed September 18, 2008, and as you were informed in Status Update Letter 09-4580 (LPC 08-7743), issued on October 14, 2008, pursuant to Section 25-307 of the Administrative Code of the City of New York. The proposed work, as approved, consisted of demolishing the existing rear dormer, constructed without Landmarks Preservation Commission permits, and the existing rear stair bulkhead; constructing new dormers at the front and rear facing slopes of the rooftop, featuring multi-light windows and standing-seam metal roofs (Pac-Clad "Weathered Zinc"); replacing the existing roof cladding at the existing pitched roof with new standing-seam metal cladding with a gray finish ("Weathered Zinc"); legalizing the metal railing at the existing rear yard addition, installed without Landmarks Preservation Commission permits; removing the altered and resurfaced brownstone door enframement, sills, lintels and base, and installing new brownstone to match the historic enframement, sills, lintels and base at the Henry Street facade; installing decorative ironwork with a black finish at the projecting parlor floor window sills; and removing the upper brick courses and coping stones at the altered masonry parapet and installing a new wood cornice with a black finish and an attached copper downspout at the Henry Street façade; The proposal was shown in historic photographs, existing condition photographs and presentation drawings, received and dated by staff on July 22, 2008 and October 14, 2008, prepared by John H. Hatheway, Jr. Architect, submitted as components of the application and presented at the Public Hearing and Public Meeting. In reviewing this application, the Commission noted that the Cobble Hill Historic District designation report describes 430 Henry Street as a Greek Revival style rowhouse built c.1840 and altered in the 20th century; and that the style, scale, materials and detailing of the building are among the features which contribute to the special architectural and historic character of the Cobble Hill Historic District. The Commission also noted that Warning Letter 08-1446 was issued 6/17/08 for "Alterations at rooftop, including installation of dormer and fence, without permit(s)." With regard to this proposal, the Commission found that the installation of front and rear dormers at the pitched roof will not cause damage to, or the removal of, any significant historic material; that the removal of the existing stair bulkhead, and the existing rear dormer installed without Landmarks Preservation Commission permits, will eliminate the inconsistent massing of structures found on the rear facing pitch of the visible roof; that the dormers will not encompass the entire width of the roof, and the historic roof pitch will be maintained at either side; that the proposed rear dormer, though visible at an angle from Kane Street and from the opposite side of the block from Cheever Place, will be centered above and pulled in from the sides of the existing rear extension, diminishing its visual association with the earlier addition; that the proposed standing-seam metal roof is in keeping with the material and detail of the types of roofs historically found on buildings of this age and style; that the design of the proposed front dormers reflects the proportions and details of historic dormers found on buildings of this age and style, including examples found in this district; and that the proposed cornice and door surround will closely match the details of the original cornice and surround as evidenced in the historic tax photograph. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve this application. However, in voting to grant this approval, the Commission stipulated that two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on April 7, 2009, the Landmarks Preservation Commission received final architectural drawings A-001, A-0110, A-011, A-020, A-021, A-022, A-023 and A-024, issued 3/26/09, and prepared by John H. Hatheway, Jr. Architect. Staff reviewed the drawings and found that the work approved by the Commission has been maintained. The work also includes removing eight (8) one-over-one double-hung windows, and removing masonry infill beneath the openings at the parlor floor, and installing new six-over-six double-hung wood windows with a white finish behind the existing brickmolds at the 1st, 2nd and 3rd floors at the Henry Street façade; and installing two (2) photovoltaic panels, to be mounted flat to the roof or with a slope no greater than 15 degrees, at the roof of the new rear dormer. With regard to this additional work, the Commission finds, in accordance with the provisions set forth in Title 63 of the Rules of the City of New York, Section 3-04, that the new windows at the primary façade will match the historic windows in terms of configuration, operation, details, material and finish; and in accordance with Section 2-19, that the rooftop addition will consist solely of mechanical equipment; that its installation will not result in damage to, or demolition of a significant architectural feature of the roof; that it will be minimally visible from a public thoroughfare; and that it will not adversely affect significant architectural features of adjacent improvements. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-8640 (LPC 09-0215) is being issued. Please note that Warning Letter 08-1446, issued 6/17/08 for "Alterations at rooftop, including installation of dormer and fence, without permit(s)," remains in force against the property until the work approved under this permit is completed and inspected for compliance. Failure to address this violation will result in the issuance of a Notice of Violation originating from the Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7-02(c). This NOV would require a court appearance, and a civil penalty may be imposed and cannot be cured. Once the corrective work has been performed, please submit photographs, with close-up shots of the completed work, and a letter from the building owner requesting a Notice of Compliance to the staff of the Commission. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves PAGE 2 Issued: 4/10/09 DOCKET: 09-0215 the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
