Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of February 17, 2009, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your
application completed January 22, 2009.

The proposed work, as approved, consists of replacing existing concrete paving throughout the sidewalk with
new concrete paving, tinted the color of granite and scored in a standard rectilinear pattern and cobblestone
paving in rectilinear bands at the street side of the sidewalk; replacing seventeen tree pits with nineteen tree pits;
installing thirty-eight flush-mounted light fixtures within the tree pits; replacing the steel-clad concrete curbing,
present throughout the majority of the site, and the four sections of existing bluestone curbing at the sidewalks
with steel-clad concrete curbing. The work was shown on eight presentation boards, labeled (pages) 1, 2, 3, 4, 5,
6 and 7; dated (presented) February 17, 2009; and consisting of drawings and photographs, all prepared by
Terrain-NYC, Inc., and presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the Tribeca North Historic District Designation Report
describes 441-453 Greenwich Street (aka 34-48 Vestry Street, 9-17 Desbrosses Street) as a Romanesque Revival
style warehouse, designed by Charles C. Haight and built in 1883-1884; and that the building's style, scale,
materials and details are among the features that contribute to the special architectural and historic character of
the Tribeca North Historic District. The Commission also noted that the existing sidewalk paving at 441-453
Greenwich Street consists of concrete paving and that the curbing is primarily steel clad concrete, with four areas
of bluestone curbing; and that Certificate of Appropriateness 08-1126 (LPC 07-9152) was issued on July 30,
2007, approving a proposal to alter the building, as well as to replace sections of concrete paving at the sidewalk
with cast iron and glass vault covers. The Commission finally noted that Warning Letter 06-0009 was issued on
July 11, 2005 for the "installation of windows at Vestry and Greenwich Street facades without permit(s)" and
advanced to a Notice of Violation on September 16, 2005.

With regard to this proposal, the Commission found that the replacement of the existing concrete paving will not
eliminate any significant, protected features of the streetscape; that the cobblestone paving will be in keeping
with the district's historic paving materials; that the proposed concrete paving will be in keeping with modern
paving materials found throughout the district; that the combination of the paving materials in simple, uniform
pattern will be harmonious with the industrial character of the streetscapes and consistent with the utilitarian
nature of paving patterns historically found throughout the district; that the concrete will be tinted to match the
color of granite and will recall the presence of historic stone paving and help to further unify the appearance of
the paving; that the tree pits will be typical in scale and placement and simple in detail, thereby not drawing
attention to themselves; that the light fixtures will be simple in design, small in scale, neutral in finish, and
installed flush with the planting beds, thereby remaining a discreet presence within the streetscape; that the
presence of light fixtures in tree pits at a building of this scale will not overwhelm the building or streetscape; that
the existing bluestone curbing only remains at a small percentage of the site, therefore its removal will not
eliminate an intact significant feature of the site; that the replacement of all of the existing curbing with steel clad
concrete curbing will support unified streetscapes; and that the proposed work will support the special historic
and industrial character of the streetscapes and historic district. Based on these findings, the Commission
determined the work to be appropriate to the sidewalk and the historic district and voted to approve the
application.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two sets of final filing drawings showing the approved design.

Subsequently, on February 19, 2009 and March 9, 2009, the Commission received tinting specifications and two
drawings, both labeled L-100, including one drawing, dated revised August 15, 2008 and prepared by Steven B.
Tupu, RLA, and one drawing, dated revised August 23, 2008 and prepared by Terrain-NYC, Inc.

Accordingly, staff reviewed the drawings and specifications and noted that the design approved by the
Commission has been maintained. Based on this and the above findings, the drawings have been marked
approved with a perforated seal, and Certificate of Appropriateness 09-7943 is being issued.

Please note that the paving pattern at the courtyard and alley and the cast iron and glass vault covers, approved by
the Commission under Certificate of Appropriateness 08-1126 and Miscellaneous/Amendments 09-6619 (LPC
09-5647), issued on January 12, 2009, are shown on the presentation boards and the final filing drawing of this
permit; and that the issuances of Certificate of Appropriateness 08-1126 and this Certificate of Appropriateness
are contingent upon the Commission's review and approval of shop drawings for the vault covers prior to the
commencement of work. Promptly forward these drawings to the Commission as soon as they are available.

Please also note that Notice of Violation 06-0009 remains in force and is not addressed by this permit; and that
Certificate of No Effect 08-1127 (LPC 08-0017) was issued July 30, 2007, approving work at the subject
premises, including window replacement to address the work cited in the Notice of Violation. Failure to
complete the corrective work, in compliance with Certificate of No Effect 08-1127, may result in the issuance of
a second Notice of Violation originating from the Environmental Control Board in accordance with Title 63 of
the Rules of the City of New York, Section 7-02 (c). This second Notice of Violation would require a court
appearance and a civil fine may be imposed.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of

approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
