Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of February 17, 2009, following the Public Hearing of the same date, voted to
approve a proposal to construct a rooftop stair bulkhead at the subject premises, as put forward in your
application completed on January 22, 2009. The approval will expire on February 17, 2015.

The proposed work, as approved, consists of the removal of an existing storage shed at the fifth floor roof and the
construction of a new beige stucco-clad stair bulkhead with a sloped zinc roof and skylight located adjacent to the
existing elevator bulkhead; as shown in existing conditions photographs and drawings labeled A-0.2, A-0.3,
A-0.4, A-2.0, and A-6.1, dated revised February 13, 2009, prepared by Abelow Sherman Architects, L.L.C.; and
submitted as components of the application, and presented at the Public Hearing and Public Meeting.

In reviewing this application, the Commission notes that the NoHo East Historic District designation report
describes 296 Elizabeth Street as a 'stripped' early 19th century building with late-20th century alterations; and
that the building's scale and massing are among the features that contribute to the special character of the NoHo
East Historic District.

With regard to this proposal, the Commission found that construction of the new roof bulkhead will not cause the
destruction of any significant historic fabric; that visible mechanical bulkheads are common in this district; that
the proposed stair and elevator bulkhead will only be visible against a backdrop of other buildings and other
modern rooftop accretions, at an acute angle to the front facade, minimizing its impact upon the skyline; that the
simple massing, stucco, glass, and zinc cladding, and details of the new bulkhead will not draw undue attention to
themselves, or call attention away from the main facade; and that for these reasons, the construction of the
rooftop bulkhead is in keeping with the building, the streetscape, and the NoHo East Historic District. Based on
these findings, the Commission determined the proposed work to be appropriate to the building and the NoHo
East Historic District and voted to approve it.

However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the
presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for
the approved work be submitted to the staff of the Commission for review and approval.

Subsequently, on February 19, 2009, the Landmarks Preservation Commission received final drawings labeled
A-0.0, A-0.2, A-0.3, A-0.4, A-1.0, A-2.0, A-6.0, and A-6.1, dated revised February 17, 2009, prepared by David
Sherman, R.A..; and drawings labeled M-1 through M-4, and P-1; dated October 29, 2008; prepared by Kevin
Kendall, P.E. Accordingly, staff reviewed the drawings and found that the proposal has been amended to include
the relocation of a metal rain leader to the northeast corner of the elevator bulkhead; removal and replacement of
decking, removal and two HVAC condensing units and installation of one new HVAC unit, relocation of exhaust
vents, and installation of six zinc planters and two new skylights at the fifth floor roof; interior alterations at the
fifth floor, including the demolition and construction of interior partitions, electrical work, mechanical systems,
plumbing, and finishes; that in accordance with the Rules of the City of New York, Title 63, Section 2-19(c)(2),
that the installation of the decking, skylights, planters, and HVAC equipment consists solely of mechanical
equipment; that it will not result in damage to, or demolition of, any significant features of the roof of the
building; and that the new equipment will not be visible from any public thoroughfares; and that the proposal
approved by the Commission has been maintained. Based on this and the above findings, the drawings are
marked approved with a perforated seal, and Certificate of Appropriateness 09-7839 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
