Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of January 15, 2008, following the Public Hearing and Public Meeting of October 9, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on September 13, 2007. This permit will expire on January 15, 2014. The work, as approved consists of removing the modern storefront infill, signage and awnings on the Broadway and West 46th Street facades, and installing wood storefront infill featuring large display windows and granite bulkhead with flush metal panel sign band above with a LED panel insert, and fixed awnings featuring open sides and bottom and looses skirt located at the two double-door entrance bays at the ground floor of the Broadway façade; installing wood frame and glass window assembly at the second floor featuring large display windows and divided transoms, featuring a flush metal panel sign band above with LED panel inset, all located on the Broadway façade; installing painted wood frame fixed windows and doors within the historic masonry openings, featuring fixed awnings with open sides and bottoms and loose skirts, attached to the frames and located at the ground floor; installing painted wood frame tripartite transoms; and extending the existing framework for the rooftop billboard sign and installing an additional billboard sign, externally illuminated. The proposal, as initially presented to the Commission called for LED signbands that wrapped around the corner of the building. All proposed work was shown in presentation boards consisting of photo boards, current condition photographs, photomontage mock-ups, and drawings labeled A-1 through A-12, dated September 26, 2007 and revised drawings labeled A6, A7 and A8, dated December 19, 2007, prepared by Tobin and Parnes Design Enterprises, submitted as components of the application, and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that 1552 Broadway (a.k.a. 167 West 46th Street), and known as I. Miller Building, Individual Landmark, is a as a four-story commercial building, which was altered in 1926 to the designs of Louis H. Friedland, and which features four statues of leading 1920s actresses, along the West 46th Street facade, designed by Alexander Calde. With regard to this proposal, the Commission found that the removal of the existing ground-floor and second-floor storefronts at the Broadway façade, and the removal of a rigid wrap-around corner awning, and multiple illuminated sign boards covering the entire Broadway façade, will result in the removal of elements which presently detract from the landmark; that the new storefront infill is based on physical documentation and details found on the 46th Street façade, and historic photographic documentation; that the proposed installation of new marble panels within the bulkheads and at the spandrels of the lower bays at the West 46th Street facade will match the historic design and material at the spandrels at the upper floors and therefore the alterations to the storefronts will unify the building; that the second floor ribbon of fixed windows with transoms, on the Broadway façade will help mimic the historic glazing pattern, thereby providing a uniform fenestration treatment; that the Broadway façade, was designed as a secondary façade and was historically covered with large sign boards, and therefore, there is historic precedent for extensive advertising signage on this building; that historically the types of signs on this building changed constantly as technology evolved which reflects the building's role in the historic development of Times Square; that the installation of the proposed dynamic advertising signs will be in keeping with the Times Square location of this individual landmark, as well as with the character of the electric signs and awnings which existed historically on this building, and will help to reinforce the relationship of this building to its site; that the proposed installation of some LED signage at the Broadway facade set within boundaries of a signband, will permit the use of state-of-the-art technology while maintaining the size and configuration of the storefront, and is in keeping with the exuberant character and spirit of Times Square, which is significant to this building's history; that the proposed fabric covered awnings with open sides and loose skirts, are in keeping with the type and location of awnings traditionally found on commercial buildings of this age and style; and that a proposed sign, on top of the existing signs, utilizing existing sign supports, and smaller in dimensions than the existing signage, be located relatively out of context from the street façade of the building, and therefore will not overwhelm or diminish the historic character of the building. Based on these findings, the Commission determined that the work is appropriate to the building and voted to approve it. However, in voting to grant this approval, the Landmarks Preservation Commission made its determination subject to the condition that that the restorative work on the facades, including storefront infill and alterations to existing signage must be completed and a Notice of Compliance be issued prior to the construction and erection of the proposed new sign, and that two sets of final signed and sealed drawings showing the approved proposal, which will be filed with the Department of Buildings, be submitted to the Landmarks Preservation Commission for review and approval. Subsequently, on March 23, 2009 the Commission received two sets of a final stamped and signed drawing labeled CS1, G001, G002, G003, G004, A100, A101, A102, A103, A110, A111, A200,A201, A300, A301, A302, A303, A304, A305, A306, A307, A308, A500, A501, dated September 23, 2008; last revised March 20, 2009, signed and sealed by Robert Mark Parnes, R.A. The Commission staff noted that the drawings included comprehensive notes and specifications for the restoration work of both facades, as well as a note indicating that the request for rooftop signage is not within this scope of work. The Commission reviewed the submitted drawings and found that the proposal approved by the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is issued contingent upon the Commission's review and approval of shop drawings and final paint color selection for the storefront infill, window restoration package, historic paint analysis and paint selection, cleaning samples, masonry samples, awning fabric color and LED panel shop drawings all prior to the commencement of the work. Please contact the Landmarks Preservation Commission staff when the samples are ready in order to arrange a site visit. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves PAGE 2 Issued: 3/26/09 DOCKET: 09-7860 the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to Kim Valente. Robert B.
