Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of December 9, 2008 following the Public Hearing of the same date, voted to approve a proposal for the legalization of a rooftop trellis at the subject premises, as put forward in your application completed November 20, 2008. This approval will expire December 9, 2014. The proposed work, as approved, consists of exterior work at the roof, including legalizing the installation of a wood trellis approximately 10-feet by 10-feet, and 9-feet tall located in the southeast corner of the roof; and installing a tension cabling railing with a black painted finish mounted to the inside of the brick parapet wall; as shown in the presentation boards showing existing condition photographs, sightline photographs, a plot plan, a roof plan, and section drawings, labeled A1, dated October 22, 2008 and A2, dated October 28, 2008, and submitted as components of the application, and presented at the Public Meeting and Public Hearing. In reviewing this proposal, the Commission noted that the NoHo Historic District designation report describes 439 Lafayette Street as a Renaissance Revival style warehouse building designed by D & J Jardine and built in 1889-90; and that in terms of its style, scale, materials, and details it contributes to the special architectural and historic character of the NoHo Historic District. This permit is being issued in conjunction with Certificate of No Effect 09-8360 (LPC 09-7866). With regard to this proposal, the Commission found that the installation has not resulted in damage to any significant architectural or historic features of the roof; that the wood trellis is only minimally visible from Lafayette Street, owing to a break in the streetwall caused by a service alley; that within the context of Lafayette Street, a busy commercial thoroughfare with a complex roofscape, the trellis does not call undue attention to itself; that the proposed metal perimeter railing at the parapet will only be minimally visible when looking north and south on Lafayette Street and its design is simple and utilitarian, thereby blending in with the roofscape within this historic district; and that the proposed work does not diminish the special architectural and historic character of the building or the historic district. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the NoHo Historic District, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on March 18, 2009, the Landmarks Preservation Commission received a specification sheet for Ultra-tec Cable Railing System; and a final drawing labeled A1, dated issued March 13, 2009, prepared by Shiming Tam, R.A. Accordingly, staff reviewed the drawings and found that the change requested by the Commission has been incorporated into the proposal and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-8322 (LPC 09-7723) is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
