Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of February 10, 2009, following the Public Hearing and Public Meeting of
January 20, 2009, voted to approve certain alterations at the subject premises, as put forward in your application
completed on December 23, 2008. The approval will expire on February 10, 2015.

The proposed work, as approved, consists of removing the entire rear facade, including the bay window at the
second floor; constructing a four-story rear yard addition that extends approximately 5 feet from the existing rear
facade, rising from the cellar level through the third floor, clad in brick, with two (2) punched openings and
double-hung windows at the second and third floors, a set of sliding doors at the ground floor, and a metal railing
at the third floor roof; rebuilding the rear facade at the fourth and fifth floors in the same plane as the existing rear
facade of new brick to match the existing, with two (2) new punched openings and double-hung windows at the
fourth floor; installing a new bay window to replicate the existing bay window in dimensions, materials, and
details, at the fifth floor; installing a rooftop bulkhead for mechanical equipment, with louvered panels and a 4
foot high parapet wall, setback approximately 5 feet from the rear facade, and replacing the existing wood fence
at the rear property line with a new brick garden wall. The proposal, as initially presented, included constructing a
full height rear addition, with a rooftop bulkhead in plane with the proposed rear facade; as shown in drawings
labeled LPC-01 through LPC-18, dated December 22, 2008.




The approved work is shown in current condition and historic photographs, presentation boards, and drawings
labeled LPC-01through LPC-22, dated February 18, 2009 submitted as components of the application, and
presented at the Public Hearing and Public Meeting.
In reviewing this proposal, the Commission noted that the Riverside/ West End Historic District describes 303
West 90th Street as an Elizabethan Renaissance style rowhouse, designed by Clarence True, and built in 1889;
and that the style, scale, materials, and details of the building contribute to the special architectural and historic
character of the Riverside/ West End Historic District.


With regard to this proposal, the Commission found that the proposed rear yard addition will not be visible from a
public thoroughfare; that because the existing rear yard is small and paved in concrete, and because other rear
yard incursions exist in the center of this block, the proposed 5 foot deep rear yard extension at the lower three
floors will not eliminate greenspace nor detract from the character or quality of the rear open space; that the
proposed extension into the rear yard is modest and will project less than other adjacent buildings and rear yard
additions in this block; that the bay window at the second floor, a significant feature of this rear facade, is
deteriorated, but will be replicated and mounted at the top floor to preserve this architectural element; that the
plane of the original facade will be preserved at the top two floors so as not to eliminate the legibility of the
original rear facade; that the chamfered wall, also a significant feature of this rear facade and block plan, will be
preserved at the top two floors; that the design of the proposed rear facade is congruous with the existing rear
facade, in terms of materials, color palette, and style; that the rooftop bulkhead will be only minimally visible
from an oblique angle from over 100 feetaway on West End Avenue, just north of 89th Street and will blend with
the roofscape; that because the proposed bulkhead will be set back from the original plane of the building, and
will be clad with metal louvers, the additional mechanical equipment bulkhead will be subordinate to the main
facade; and that the proposed alterations to the rear facade will not diminish the historic or architectural integrity
of the building, the row or the Riverside-West End Historic District. Based on these findings, the Commission
determined the proposed work to be appropriate to the building and to the Riverside-West End Historic District,
and voted to approve it.



The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review, and approval
of two (2) signed and sealed copies of the final Department of Buildings filing drawings.



Subsequently, on February 25, 2009, the Commission received drawings, labeled LPC-01, LPC-02, LPC-03,
LPC-04, LPC-05, LPC-06, LPC-07, LPC-08, LPC-09, LPC-10, LPC-11, LPC-12, LPC-13, LPC-14, LPC-15,
LPC-16, LPC-17, LPC-18, LPC-19, LPC-20, and LPC-21, dated February 18, 2009,
all prepared by Svetislave Darko Don Zivkovic R.A. The Commission reviewed thse drawings and found that
the approved proposal has been maintained. Based on this and the above findings, the drawings have been
marked approved with a perforated seal, and Certificate of Appropriateness 09-7826 (LPC 09-7283) is being
issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
