Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of November 18, 2008, following the Public Meeting and Public Hearing of
October 7, 2008, voted to approve the proposed work at the subject premises, as put forward in your application
completed September 11, 2008. This approval will expire November 18, 2014.

The proposed work, as approved, consists of the demolition of a portion of the roof, and the construction of a
one-story rooftop addition, featuring metal cladding, a glass block opening on the western façade, large panes of
glass on the southern façade; the installation of two skylights at the roof; the installation of five air conditioning
units on steel dunnage recessed into the front portion of the roof; the construction of a brick parapet wall at the
rear; the extension of the fire-escape ladder; the removal of the concrete staircase at the rear yard, and the
construction of new concrete staircase adjacent to the hatch at the cellar; and re-locating the historic iron gate at
the rear areaway to accommodate the new staircase; the proposal, as initially presented included existing
conditions photographs and drawings labeled (by staff) Site Plan, Proposed with Parapet and Penthouse
Mock-Up, Existing and Proposed cellar, basement, first through fourth floor, and roof plans, Existing and
Proposed side, rear and front elevations, Proposed Extension elevations, Existing and Proposed cross sections,
and Rear 122nd Street photomontage, prepared by K.T. Seung, P.E., shown as components of the application and
presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the Mount Morris Park Historic District designation report
describes 241 Lenox Avenue as a rowhouse designed by A.B. Van Dusen and built in 1883-85; and that the
building's style, scale, materials, and details are among the features that contribute to the special architectural and
historic character of the Mount Morris Park Historic District. The Commission also noted that this permit is
issued in conjunction with Certificate of No Effect 09-6195 (LPC 09-3419) for restorative work at the primary
façade.
With regard to this proposal, the Commission found that the construction of the addition will not cause the
removal of significant architectural features at the roof; that the proposed addition will be recessed into the roof
structure, and set back from the building facades, and therefore will not overwhelm the building; that the addition
will be only minimally visible over the primary facades; that the addition will be most visible from the west over
the rear façade but will be obscure from view by the proposed rooftop railing;
that the building is already taller than the adjacent row on the corner from the north and south on Lenox, so the
addition will not diminish this building's relationship to the adjacent buildings; that the metal cladding material
and finish of the proposed addition is typical of rooftop features and will cause the addition to blend in within the
roofscape; that the glazing at portions of the northern and eastern elevations of the rooftop addition will be only
minimally visible from any public thoroughfare; that the alterations at the rear yard and areaway, including
moving the existing concrete staircase location and constructing a staircase to the cellar will not cause the
removal of historic fabric; that the existing historic iron areaway fencing will be carefully removed and
reinstalled at a new location within the rear areaway; and that the proposed work will not diminish the special
architectural and historic character of the building or the historic district. Based on these findings, the
Commission determined the proposed work to be appropriate to the building and the historic district, and voted to
approve it.

However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the
presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for
the approved work be submitted to the staff of the Commission for review and approval.

Subsequently, on January 26, 2009, the Landmarks Preservation Commission received final drawings labeled
T-101, T-102, D-101 through D-103, A-101, A-102, A-201 and A-301, dated February 1, 2008, prepared by
Kwong T. Seung, P.E. Accordingly, staff reviewed the drawings and found that the proposal approved by the
Commission has been maintained. Based on this and the above findings, the drawings are marked approved with
a perforated seal, and Certificate of Appropriateness 09-6295 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
