Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 3, 2009, following the Public Hearing of the same date, voted to approve a proposal to install new storefront infill and signage at the subject premises, as put forward in your application completed on February 5, 2009, and as you were notified in Status Update Letter 09-7814 (LPC 09-5617) issued on March 5, 2009. The approval will expire on March 3, 2015. The proposed work, as approved, consists of the removal of existing storefront infill and associated security roll down gates and signage at the western three (3) bays at the ground floor; installation of new storefront infill across these three bays, including two large display windows with paneled bulkheads and one (1) set of paired doors with a transom; aluminum framing with a grey-painted finish; a fixed red fabric awning with a loose skirt; and individual pin-mounted letters "Checkers" and "Burgers-Fries-Colas" within the spandrel; as shown in current condition and historic photographs, and drawing labeled A-01, dated December 3, 2008, and presentation boards 1, 2, 3, 4, and 5, prepared by Cherico King, R.A., and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the Tribeca South Historic District designation report describes 77 Chambers as an Italianate style cast iron building designed by Samuel A. Warner, and built in 1857; and that the building's style, scale, materials, and details contribute to the special architectural and historic character of the Tribeca South Historic District. The Commission also noted that the infill at the lower two floors was installed in 1926; and that portions of this infill have been altered and are deteriorated. With regard to this proposal, the Commission found that the proposed work will not involve the removal of original building fabric; that while the existing configuration of the storefront dates from 1926, portions are significantly compromised today; that the proposed work will eliminate two (2) sets of security roll down gates, features that detracts from the historic and architectural character of this storefront; that the proposed storefront infill will maintain a rhythm which relates to the original building fabric at the upper floors; that the configuration and proportions of the storefront with large display windows, paired doors with a transom, and paneled bulkheads are in keeping with the historic storefronts found within the historic district; that the square aluminum framing, while modern, will not compete with, or detract from, significant architectural features; that the proposed grey painted finish of the storefront framing will match the upper floors and will help to unify this altered facade; that the proposed signage, consisting of non-illuminated pin-mounted letters in the spandrel and a plain red fixed awning, with a flexible skirt and open sides, is relatively simple and unobtrusive for a storefront on this block; and that the proposed work will not diminish the special architectural and historic character of the building or the Tribeca South Historic District. However, in voting to grant this approval, the Commission stipulated that the architect work with Landmarks Preservation Commission staff to monitor the installation and determine the location of the original lintels and piers, and to adjust the final storefront dimensions if need be; and that two (2) copies of the final signed and sealed Department of Buildings filing drawings and one (1) reduced set of the presentation boards be submitted to the Landmarks Preservation Commission for review and approval. Subsequently, on March 11, 2009 , the Commission received drawings labeled A-001-00, A-002-00, and A-003-00, dated March 10, 2009, prepared by Cherico King, R.A. The Commission reviewed the drawings and found that the proposal has been amended to include the installation of a new 18" diameter flue at the visible rear facade, painted to blend with the surrounding masonry; and that, in all other apsects, the approved proposal has been maintained. With regard to the proposed flue, the Commission finds that the proposed installation consists only of mechanical equipment; that the new equipment will not compete with, detract from, or adversely affect significant architectural features of the building or of adjacent buildings or improvements. Based on these and the above findings, the drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 09-8153 (LPC 09-7566) is being issued. . This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
