Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of January 6, 2009, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your
application completed on December 11, 2008, and as you were informed in Status Update Letter 09-6464 (LPC
09-5753), issued on January 6, 2009.

The proposed work, as approved, consists of installing four 11-1/2" by 11-1/2" illuminated, bronze menu display
boxes and 4" high pin-mounted, brass signage letters and logo ("Rouge Tomate") at the fourth westernmost
ground floor limestone pier of the front facade of the building. The work was shown on two presentation boards,
labeled 1 and 2 by the Commission staff; dated (presented) January 6, 2009; and consisting of drawings,
photographs, and photomontages, all prepared by Bentel and Bentel Architecture/Planning Design, LLP, and
presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the Upper East Side Historic District Designation Report
describes 10-14 East 60th Street as a Beaux-Arts style hotel building, designed by R.C. Gildersleeve and built in
1902; and that the building's style, scale, materials and details are among the features that contribute to the special
architectural and historic character of the historic district. The Commission also noted that Warning Letter
09-0773 was issued on December 17, 2008 for the "installation of security cameras at 1st floor facade without
permit(s)."

With regard to this proposal, the Commission found that the presence of the display boxes and sign will be in
keeping with the character of signage historically found at buildings of this type, style and age; that the simple
design of the individual display boxes and sign, in conjunction with their brass and bronze materials and their
small scale, will be harmonious with the building's overall design; that the installations will be easily reversible;
and the installations will not diminish the special architectural and historic character of the building and the
Upper East Side Historic District. Based on these findings, the Commission determined the work to be
appropriate to the building and the historic district and voted to approve it with the stipulation that the signage
and display boxes be installed on horizontal brackets, connecting the installations and limiting the penetrations
into the masonry, and that any penetrations for electrical connections be minimized or eliminated.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two sets of the final filing drawings showing the approved design.

Subsequently, on March 6, 2009, the Commission received final drawing A 23/41, dated revised March 5, 2009
and prepared by Frederick R. Bentel, RA. Accordingly, staff reviewed the drawing and noted that the design
approved by the Commission has been maintained and the changes required by the Commission, including the
incorporation of brackets and limitiation of penetrations, have been incorporated into the proposal. Based on
these and the above findings, the drawings have been marked approved with a perforated seal and Certificate of
Appropriateness 09-8067 is being issued.

PLEASE NOTE: Warning Letter 09-0773 remains in effect and is not addressed by this permit. Failure to
resolve this matter may result in the issuance of a Notice of Violation (NOV) originating from the Environmental
Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7-02 (c).

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
