Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of June 17, 2008, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on May 22, 2008. This permit will expire on June 17, 2014. The work, as approved, consists of installing an iron railing at the southernmost bay; removing the existing transom and window, and reconfiguring the infill by installing wood multi-light windows featuring a dark green painted finish, located at the center bay; installing a metal railing, metal gates and wood panel door at the below grade entry at the center bay; reconfiguring the existing window assembly by installing a wood multi light door with a pair of casement window featuring a dark green painted finish at the northernmost bay; installing an auto door operators post within the concrete sidewalk; and installing a bronze sign affixed to the masonry pier; as shown in presentation boards labeled 2-10, dated May 20, 2008 and six unlabeled boards with photographs and maps, dated June 9, 2008, all prepared by Penta Studio Architecture, submitted as components of the application, and presented at the Public Hearing and Public Meeting. The proposal as initially presented to the Commission included installing an aluminum finished sign. In reviewing this application, the Commission notes that La Grange Terrace Individual Landmark designation report describes 434 Lafayette Street as one of a group of four remaining Greek Revival-style townhouses, which are unified by a continuous two-story Corinthian colonnade, originally built in 1832-33, and attributed to Seth Geer. The Commission also noted that the building is located within the NoHo Historic District. With regard to this proposal, the Commission found that removing the existing window and related area of plain masonry will not cause the destruction of any significant architectural features of the building; that the proposed door will match the configuration, details and finish of other doors found in this row of individual landmark; that the portion of the opening to be altered to accommodate a new stair and lift will be concealed from view by its location in a deeply recessed opening below grade level; that the material, details, dimensions and painted finish of the window infill will match the other window details on the facade; that the installation of light weight metal railings at the entrance will not cause any damage to the masonry, will utilize existing penetrations to the façade, and will not detract from the architectural features of the facade; that the vertical post to operate the door for accessibility, will be installed on a plain concrete sidewalk, and will be consistent with utilitarian hardware associated with commercial entrances; that the installation of one bronze wall sign attached to the plain masonry, utilizing existing penetrations, and aligned with the masonry joint will not cause damage to the build façade, and that its location on the façade relates to the location of the tenant entrance which it will represent. Based on these findings, the Commission determined that the work is appropriate to the building and voted to approve this application. However, in voting to grant this approval, the Landmarks Preservation Commission made its determination subject to the condition that two sets of final signed and sealed drawings showing the approved proposal, which shall be filed with the Department of Buildings, be submitted to the Landmarks Preservation Commission for review and approval. Subsequently, on January 28, 2009 the Commission received two sets of a final stamped and signed drawing labeled A1.00, A1.01, A1.02, A2.01, A3.01, A4.01, A4.02, A6.01, A8.01, dated May 19, 2008; last revised October 15, 2008, signed and sealed by C. Anthony Winters, R.A. and drawings labeled S1S2 and S3, dated May 13, 2008; last revised February 3, 2009, signed and sealed by Robert James Murray, P.E. The Commission reviewed the submitted drawings and found that the proposal approved by the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is contingent upon the Commission's review and approval of shop drawings for the windows. Please contact the Landmarks Preservation Commission staff in order to review when ready. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
