Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of February 17, 2009, following the Public Hearing of the same date, voted to approve a proposal to install a stair enclosure at the terrace, as put forward in your application completed January 22, 2009. The approval will expire February 17, 2015. The work, as approved, consists of the installation of a metal and glass retractable cover at the existing stair at the terrace, which will protrude 6" above parapet at the terrace; and reducing the height of the adjacent low masonry bulkhead by 6", and cladding it with a champagne colored metal that will match the finish of the retractable stair cover. The work was shown on presentation boards consisting of existing condition photographs, a site map, photomontages and drawings labeled A-1 through A-5, dated 10/29/08, prepared by Acheson Doyle Partners Architects, and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that St. Bartholomew's Church, is a Byzantine-style church, designed by Bertram Goodhue, and constructed in 1914-19. The Commission further noted that CNE 07-7935 was issued on 4/26/09 for installation of a stair leading down from the terrace to 50th Street, and that the completion of this work has subsequently created water infiltration problems, and raised security concerns. With regard to this proposal, the Commission found that the installation of the stair cover will not damage or destroy any significant historic features of this Individual Landmark; that the new retractable stair cover will be almost imperceptible above the parapet wall when viewed from 50th Street; that the stair cover will have a limited corridor of visibility from Park Avenue, appearing at the terrace when one looks up the steps that lead from the sidewalk to the church; that the metal and glass stair cover will have a low profile and a muted champagne finish that will harmonize with the plaza and not call attention to itself; that the proposal calls for the existing low masonry bulkhead beside the stair to be reduced by 6 inches, and covered in the same muted champagne cladding, which will make the bulkhead's presence less obtrusive at the terrace; and that the new metal and glass retractable stair cover will provide a discreet solution to the water-infiltration and security issues connected to the existing stair that leads from 50th Street up to the terrace level. Based on these findings, the Commission determined the proposed work to be appropriate to this Individual Landmark Building, and voted to approve the proposal. The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two sets of signed and sealed Department of Building filing drawings showing the approved design. Subsequently, on February 20, 2009, the Landmarks Preservation Commission received final drawings labeled A-1 through A-5, dated 10/29/08, prepared by Michael Doyle, R.A. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 09-7687 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
