Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of November 25, 2008, following the Public Hearing on November 13, 2008
(no quorum), voted to approve the proposed work at the subject premises, as put forward in your application
completed on November 21, 2008, and as you were informed in the Status Update Letter issued on November 25,
2008 (SUL 09-5644, LPC 09-3052). This approval will expire on November 25, 2014.

The proposed work, as approved, consists of removing the existing wood pivot windows at the second floor
storefront, and installing new aluminum windows in each opening, consisting of fixed panes and hopper
windows, finished black. The proposal, as initially presented, called for a bronze anodized finish, as shown in
photographs and revised drawings W-2 and W-5 dated December 15, 2008, prepared by Paul Gregory, RA,
submitted as components of the application, and presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the Ladies' Mile Historic District Designation Report
describes 5 West 20th Street as an Italianate style dwelling built in 1852 and altered in 1904 to accommodate
storefronts at the first and second stories; and that the building's style, scale, materials and details are among the
features that contribute to the special architectural and historic character of the Ladies' Mile Historic District.

With regard to this proposal, the Commission found that the proposed windows will recall the configuration and
proportions of historic storefronts found on buildings of this age and type, which typically featured large single
display windows with transoms; that the display windows will be consistent with the size and scale of windows
found in other historic buildings altered in the early 20th century to accommodate storefronts in this district and
will be in keeping with the commercial character of the building and the historic district; that in terms of the
material, the aluminum windows are consistent with the cast and pressed metal material of second floor storefront
display windows added in the early 20th century; that the framing details and factory applied finish will reflect
the details, profiles and finish of early 20th century display windows found in buildings of this age and type; and
therefore, the proposed windows are supportive of the special architectural and historic character of the Ladies'
Mile Historic District. Based on these findings, the Commission determines that the proposed work is
appropriate to the building and to the Ladies' Mile Historic District, and voted to approve this application.

However, the Commission made its determination subject to the condition that the approval be made contingent
upon the paint color and finish of the proposed windows to be reviewed and approved by staff, and that a set of
unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of
Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and
approval.

Subsequently, on December 30, 2008, the Landmarks Preservation Commission received final revised drawings
W-2 and W-5 dated December 15, 2008, and signed and sealed by Paul Gregory, RA. Staff reviewed the
drawings and paint sample and found that the work also included interior alterations at the second and third
floors, including the demolition and construction of non-bearing partitions, finishes and plumbing fixtures; and
the replacement of existing defective floor joists with new floor joists; that the paint inspection was determined
inconclusive due to the deteriorated condition of the existing paint layers; and that the proposed black finish will
be consistent with the finishes found on early-20th century style commercial storefronts in manufacturing and
commercial districts; and found that the proposal approved by the Commission has been maintained. Based on
this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of
Appropriateness 09-7536 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
