Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of February 17, 2009, following the Public Meeting and Public Hearing of
February 3, 2009, voted to approve the proposed work at the subject premises, as put forward in your application
completed January 8, 2009. This approval will expire February 17, 2015.

The proposed work, as approved, consists of exterior work at the rear façade, including the removal of a
non-decorative fire escape; demolition of the two-story rear yard addition; and the construction of a 13' 6" deep,
full width, three-story rear-yard addition, featuring paired wood and glass doors at the basement and second
floors, casement windows and transoms at the ground floor; the removal of a one-over-one, double-hung window
at the fourth floor, enlargement of the window opening, and the installation of a door within the enlarged
opening; the installation of terrace pavers and a railing at the third floor; and interior alterations at the basement,
first through fourth floors; as shown in existing conditions photographs and boards labeled LM-201, LM-203,
BD-1, BD-3 through BD-12, LM-201.1, LM-202, LM-203, dated revised December 22, 2008, prepared by Freyer
Collaborative Architects, shown as components of the application and presented at the Public Hearing and Public
Meeting. The proposal, as originally proposed, featured a 14' 6" deep addition, with a third story setback and two
terraces.

In reviewing this proposal, the Commission noted that the Cobble Hill Historic District designation report
describes 15 Tompkins Place as a Greek Revival style rowhouse built in the 1840s. The Commission also notes
that this permit is issued in conjunction with Permit for Minor Work 09-7415 (LPC 09-3563), issued February 20,
2008 for window replacement; Certificate of No Effect 09-6481 (LPC 09-6144), issued January 6, 2009 for
interior alterations; and Permit for Minor Work 09-3782 (LPC 09-0902), issued September 18, 2008 for
restorative work at the primary facade. The Commission finally notes that Notice of Violation 91-0026 was
issued on July 13, 1990, for, "the ongoing facade work without permit(s)," Notice of Violation 08-0388 was
issued January 11, 2008 for "replacement of windows without permit(s)," and Notice of Violation 08-0389 was
issued November 20, 2007 for "installation of security grilles at basement without permit(s)."

With regard to this proposal, the Commission found that the demolition of the existing rear yard addition will not
eliminate any significant architectural features; that the proposed rear yard addition will not be visible from any
public thoroughfare; that the proposed rear yard addition will not rise to the full height of the building and will
retain the historic plane of the rear wall at the upper stories thereby retaining its relationship to the row; and that
the other houses in this row currently feature rear yard additions and the presence of an addition on this building
will not detract from its relationship to the row and will not overwhelm this or the adjacent buildings. Based on
these findings, the Commission determined the proposed work to be appropriate to the building and the historic
district, and voted to approve it.

However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the
presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for
the approved work be submitted to the staff of the Commission for review and approval.

Subsequently, on February 18, 2008, the Landmarks Preservation Commission received final drawings labeled
BD-1 through BD-13, BD-13.1, BD-17 and BD-18, dated revised December 22, 2008, prepared by Warren
Freyer, R.A. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission
has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated
seal, and Certificate of Appropriateness 09-7447 is being issued.

Please be advised that Landmarks Preservation Commission Violation 00-0016, issued July 23, 1999, for
"replacement of windows throughout front facade without permit(s)" remains in effect against the property. This
permit has been issued in reliance upon Freyer Collaborative Architects demonstrated intention to perform work
to correct the violation pursuant to Permit for Minor Work 09-3782 (LPC 09-0902) and Permit for Minor Work
09-7415 (LPC 09-3563), as evidenced by the escrow agreement, dated June 13, 2008, between between Candida
Ruiz, as owner and D'Agostino Levine and Landesman as escrow agent.

PLEASE ALSO NOTE that Notice of Violation 91-0026, 08-0388 and 08-0389 remain in force against the
property. Failure to address these violations will result in the issuance of a second Notice of Violation originating
from the Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section
7-02(c). This NOV would require a court appearance, and a civil penalty may be imposed and cannot be cured.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
