Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of of October 21, 2008, following the Public Hearing of October 21, 2008,
voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your
application completed on September 25, 2008.

The proposal, as approved, consists of the construction of rooftop additions, each with a flat roof, with limestone
cladding on the front and rear facades of the addition on 12 East 62nd Street, and copper cladding on the front
and rear facades of the addition on 14 East 62nd Street, all not visible from the street, as shown in drawings
L-001, L-002, L-100 through L-103, L-601 through L-605, and L-700, all dated October 14, 2008, L-003 and
L-004, both dated October 1, 2008, EX-200 and L-200, both dated October 17, 2008, EX-201, EX-401, L-202,
L-400, L-400.1, and L-401, all dated September 18, 2008, L-104, dated October 20, 2008, L-104A, dated October
21, 2008, L-200.1, L-201, L-201.1, L-300, and L-600, all dated October 16, 2008, and L-301, dated October 9,
2008, which included photographs, all prepared and presented at the Public Hearing and the Public Meeting by
Joseph Pell Lombardi and Associates. As originally presented at the Public Hearing and Public Meeting, the
proposed addition had pitched roofs and matching stucco cladding on the front and rear facades of each building.

In reviewing this proposal, the Commission noted that the Upper East Side Historic District Designation Report
describes 12 and 14 East 62nd Street as two rowhouses built in 1879-80 and redesigned in the neo-French Classic
style by Harry Allan Jacobs in 1915-16; and that the buildings' style, scale, materials, and details are among the
features which contribute to the special architectural and historic character of the Upper East Side Historic
District. The Commission further noted that 12-16 East 62nd Street were all redesigned by Harry Allan Jacobs in
1915-16 as a unified group, with similar proportions, details, and materials.

With regard to this proposal, the Commission found that the construction of the proposed rooftop additions will
not cause damage to any significant architectural features of these buildings; that the proposed rooftop additions
will not be visible from a public thoroughfare; that the additions will be limited to one floor set back from the
front and rear facades, and therefore will not overwhelm or diminish the scale and character of these rowhouses;
and that for these reasons the proposed work will not diminish the special architectural or historic character of
the building or the Upper East Side Historic District. Based on these findings, the Commission determined the
proposed work to be appropriate to the building, and voted to approve it.

However, in voting to grant this approval, the Commission made its determination subject to the following
condition;

1. that the floor to ceiling heights of the rooftop additions be lowered to minimize the height; that they feature flat
roofs; and that the detailing of the additions be modified, so that they are not identical to each other, to indicate
that 12 and 14 East 62nd Street were built as two different buildings, and that drawings showing this modification
be submitted to the Commission for review.

On November 7, 2008, the Commission received plan and section drawings BD-103 and BD-300, for 12 East
62nd Street, and also BD-103 and BD-300 for 14 East 62nd Street, all dated November 6, 2008, prepared and
submitted by Joseph Pell Lombardi and Associates. On December 22, 2008, the Commission received drawings
BD-200 and BD-201 for 12 East 62nd Street and also BD-200 and BD-201 for 14 East 62nd Street, all dated
December 19, 2008, also prepared and submitted by Joseph Pell Lombardi and Associates. Staff has reviewed
these materials and finds that the changes required by the Commissioners, lowering the ceiling heights at the
rooftop additions on both buildings, and modifying the design to differentiate between the buildings, by
providing limestone cladding on the addition at 12 East 62nd Street and copper cladding on the addition at 14
East 62nd Street, have been incorporated into the proposal. Based on this and the above findings, these drawings
have been marked approved with a perforated seal, and Certificate of Appropriateness 08-5470 is being issued.

The approved work is limited to that described above. Please note that this permit is being issued in conjunction
with Certificate of No Effect 09-5471, issued on January 7, 2009, for facade restoration on both the primary and
secondary facades of 12 to 18 East 62nd Street, including masonry cleaning and repairs, restoration of the historic
leaded glass windows at 12 and 18 East 62nd Street, replacement of windows which are not "special;" windows
as defined under the Window Rules, repairs to the historic ironwork, and restoration of the painted metal cornices
at 16 and 18 East 62nd Street, and also interior alterations; and with Modification of Use 09-5461, docket
09-3779, dated January 7, 2009, in support of an application at the City Planning Commission for the issuance of
a special permit pursuant to Section 74-711 of the Zoning Resolution to permit exceeding the height limitations at
these buildings.

The Commission notes that the applicant is applying to the City Planning Commission for a Special Permit
pursuant to Section 74-711 of the Zoning Resolution. Any changes to the design required by the City Planning
Commission approval must be submitted to the Landmarks Preservation Commission for review and approval
prior to the issuance of the final approval letter.

PLEASE NOTE: This permit is issued contingent upon the Commission's review and approval of the final
Department of Building filing set of drawings. No work can begin until the final drawings have been marked
approved by the Landmarks Preservation Commission with a perforated seal. Please submit these drawings to the
Landmarks Preservation Commission staff when they become available.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of

approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
