Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of November 18, 2008, following the Public Hearing and Public Meeting of October 7, 2008, voted to approve a proposal for work at the subject premises, as put forward in your application completed September 11, 2008. This approval will expire November 18, 2014. The proposed work, as approved, consists of removing three one-over-one, double-hung windows at the west end of the Perry Street façade; enlarging the opening at the easternmost window; installing a new metal and glass door and transom in the enlarged opening; installing new fixed, single-pane metal windows in the two existing window openings; installing one 18"x18" wood plaque sign adjacent to the new door; and installing a new concrete step and black metal railings at the new door, as shown in drawings A-0 throguh A-10 dated October 1, 2008, and A-1, A-2, A-3, A-4, A-8, and streetscape photographs dated October 29, 2008, submitted as components of the application, and presented at the Public Meetings and Public Hearing. The proposal as initially presented included combining and enlarging two window openings to create one large display window with a wood bulkhead and installing a wood signband. In reviewing this proposal, the Commission noted that the Greenwich Village Historic District Designation Report describes 92 Perry Street as an apartment house designed by Charles J. Rheinschmidt and built in 1914; and that in terms of its style, scale, materials, and details, it contributes to the special architectural and historic character for which the Greenwich Village Historic District was designated. With regard to this proposal, the Commission found that the removal of the existing windows and enlargement of one window opening will not result in loss a significant amount of historic fabric; that the proposed new door opening is in keeping with doors openings historically found on this façade of this building; that the retention of the individual window openings and installation of a single door will maintain the residential character of this side of the building; that the proposed metal and glass door and transom will match the existing single retail door on this façade; that the proposed single pane, fixed metal windows will match other windows at the first floor and give a uniform treatment of the first floor of the building; that the proposed 18"x18" wood plaque sign is in keeping with the scale of the building and will not call undue attention to itself; that the proposed concrete step and simple black metal railings are in keeping with building entrances found in the historic district; and that the work will detract from the special character of the Greenwich Village Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve this application. However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, the Landmarks Preservation Commission received final drawings A-1, A-2, A-3, A-4, and A-8 dated October 29, 2008 and prepared by Marc Kemeny, R.A. Accordingly, staff reviewed the drawings and found that the work also includes interior alterations that will have no effect on the significant architectural features of the building; and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-7042 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
