Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of January 8, 2008 following the Public Hearing of the same date, voted to approve a proposal for a one-story rooftop addition at the subject premises, as put forward in your application completed December 13, 2007. This approval will expire January 8, 2014. The proposed work, as approved, consists of the removal of the one-story rear yard extension; constructing a one-story rooftop addition setback approximately 23-feet from the Mount Morris Park West façade, approximately 2-feet, 6-inches from the rear façade, and approximately 9-feet in height at the front façade of the addition sloping towards the rear to a height of approximately 8-feet, featuring floor to ceiling plate glass windows, transoms, and paired doors on the front and rear elevations with a bronze-tone standing seam roof; installing six (6) 3-foot tall air conditioning condenser units on the roof of the proposed addition; installing a rooftop deck on the main roof, with bluestone pavers, wood decking, planters, benches, and a brick fireplace at the existing front chimney and extending its flues approximately 7-feet, 6-inches above the main roof; and exterior work at the Mount Morris Park West elevation, including re-painting the cornice and paired wood entry doors dark green (Benjamin Moore "Black Forest Green"); and re-painting the window sashes and wood brick molds dark green (Benjamin Moore #2136-20 "Regent Green"); as shown in the presentation boards, showing existing condition photographs, an area map, photo montages, sightline studies, rendered section, plan, and axonometric drawings, and section drawings labeled AA-08, and submitted as components of the application, and presented at the Public Meeting and Public Hearing. In reviewing this proposal, the Commission noted that the Mount Morris Park Historic District designation report describes 32 Mount Morris Park West as a neo-Classical style rowhouse built in 1880-81; and that in terms of its style, scale, materials, and details it contributes to the special architectural and historic character of the Mount Morris Park Historic District. With regard to this proposal, the Commission found that the demolition of the one-story rear yard extension will not result in the loss of any significant architectural features; that the proposed rooftop addition with its setbacks will be only minimally visible at an oblique angle from Lenox Avenue and Mount Morris Park, owing to a break in the streetscape caused by a lower adjacent building; that the rooftop addition is modest and will not substantially increase the volume of the building or overwhelm or alter the scale of the building; that the simple design, massing, and materials of the proposed rooftop addition will not call undue attention to the addition; and that the work will not detract from the architectural and historic character of the building and the historic district. The Commission also finds that the proposed work will aid in the long-term preservation of the building; that the specified cornice, entry door, and window paint colors are in keeping with the historic paint palette; that no portion of the masonry façade will be painted; and that the restoration will not cause the removal of any significant architectural fabric. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Mount Morris Park Historic District, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on August 25, 2008, the Landmarks Preservation Commission received paint samples; final drawings labeled S-1, S-2, and S-3, dated issued February 18, 2008, prepared by Danny Isla, P.E; drawing labeled A-30, dated issued September 2, 2008; and drawings labeled A-20, A-21, A-22, A-23, and A-24, dated issued August 8, 2008, all prepared by Jon David Libasci, R.A. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-3225 (LPC 09-1999) is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
