Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of August 5, 2008 following the Public Hearing of the same date, voted to approve a proposal for rooftop and rear yard additions at the subject premises, as put forward in your application completed July 10, 2008. This approval will expire August 5, 2014. The proposed work, as approved, consists of the removal of the three-story rear ell, metal decks, rear façade, and one (1) rooftop air conditioner condensing unit; and the construction of a five-story painted brick rear yard extension and a one-story black-zinc clad rooftop addition setback 14-feet, 3 ¾-inches from the front elevation; constructing a full width glass and a steel deck at the parlor floor projecting 6-feet into the rear yard with a wood and steel trellis mounted to the rear façade above the deck at the 2nd floor; installing one (1) roof access hatch, three (3) skylights, and three (3) air conditioner condensing units on the roof of the proposed rooftop addition; installing a wood deck at the front of the main roof, with benches and a table; and extending the boiler flues and exhaust vents to three feet above the proposed rooftop addition; as shown in the presentation boards showing existing condition photographs, historic tax photographs, a site plan, a block plan, sightline studies, color renderings, existing and proposed floor plans, roof plans, sections, and elevation drawings, all labeled A002, A003, A004, A005, A101, A102, A103, A104, and LPC-1 through LPC-13, dated June 11, 2008, and submitted as components of the application, and presented at the Public Meeting and Public Hearing. In reviewing this proposal, the Commission noted that the Metropolitan Museum Historic District designation report describes 12 East 78th Street as a neo-Italian Renaissance style rowhouse built in 1886-87; and that in terms of its style, scale, materials, and details it contributes to the special architectural and historic character of the Metropolitan Museum Historic District. This permit is being issued in conjunction with Certificate of No Effect 09-2727 (LPC 09-2577). With regard to this proposal, the Commission found that the removal of the existing rear yard ell, a deck, and the removal of the rear façade will not damage or destroy any significant architectural features of the building; that the proposed full height rear yard painted masonry extension, one-story rooftop addition clad with black zinc, and glass and steel porch and canopy will only be minimally visible from East 77th Street, owing to a break in the streetscape caused by a service alley; that the presence of the additions will not overwhelm or diminish the sense of the row because the rear façades in this row have all been altered in some way either with rooftop additions that raised the height of the rear wall, or substantial rear yard additions; that the proposed addition will project less than the existing rear yard ell and therefore, will increase the central greenspace; and that proposed work will not diminish the special historic and architectural character of the building or the Metropolitan Museum Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Metropolitan Museum Historic District, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on August 8, 2008, the Landmarks Preservation Commission received final drawings labeled LPC-1 through LPC-14, A002, A003, A004, A005, A101, A102, A103, and A104, dated issued June 11, 2008, prepared by Steven Harris, R.A. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-2700 (LPC 08-8309) is being issued. As the approved work consists of subsurface work, the applicant is required to strictly adhere to the Department of Buildings' TPPN 10/88 governing in-ground construction adjacent to historic buildings. It is the applicant's obligation at the time of applying for their DOB permit to inform DOB that the TPPN applies. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
