Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of June 10, 2008 following the Public Hearings of March 4, 2008 and
February 26, 2008 (item read into the record only, not heard), voted to approve with modifications a proposal for
work at the subject premises, as put forward in your application completed on January 31, 2008, and as you were
informed in the Status Update Letter issued on June 10, 2008 (SUL 09-0751, LPC 08-5082). This approval will
expire on June 10, 2014.

The proposed work, as approved, consists of installing a new cast aluminum and glass guard house within the
West End Avenue archway; cladding the existing non-historic concrete bench, steps, and planters at the north
façade with granite to match the existing building; installing new metal molding and concealed light fixtures
under the existing courtyard canopies; replacing paired and single wood doors at the north and west façades with
single wood doors detailed to replicate the appearance of paired doors; replacing two non-historic doors in the
courtyard with new wood doors; replacing two non-historic lampposts flanking the West End Avenue driveway
with new bronze multi-globe lampposts; replacing the non-historic, plastic light globes within the courtyard with
new glass sphere light globes atop the existing electric fixtures; replacing the non-historic pavers at the courtyard
garden walkways with new granite pavers; installing four garage vents within the existing planting beds of the
courtyard garden; and replacing in-kind the asphalt pavers at the courtyard drives, as shown in drawings 1
through 13 presented March 4, 2008, and drawings L-1 through L-11 presented June 10, 2008, submitted as
components of the application and presented at the Public Meeting and Public Hearing. The proposal as initially
presented to the Commission and not approved included a different design of the guardhouse, removing the
concrete bench and restoring the areaway wall, installing a pressed tin ceiling and pendant light under the
courtyard canopies, a different profile for the metal molding under the canopies, a different design of the new
lampposts at the West End Avenue driveway, replacing the plastic globes with metal and glass lanterns and
converting existing electric light fixtures to gas, altering the footprint of the courtyard drives, and installing
granite pavers at the courtyard drives in a herringbone pattern.

In reviewing this proposal, the Commission noted that the Designation Report describes the Apthorp Apartments,
390 West End Avenue, aka 2201-2219 Broadway, as an Italian Renaissance style apartment building designed by
Clinton and Russell and built in 1906-08.

With regard to this proposal, the Commission found that the design of the proposed gatehouse at the West End
Avenue archway will be similar to the design of the historic metal canopies within the courtyard; that the
materials and details of the proposal gatehouse will be in keeping with those of the historic canopies; that the size
and scale of the proposed gatehouse will relate well to those of the entrance gate and arch; that the presence of the
proposed gatehouse will diminish neither the main building facade nor the character of the entranceway and
courtyard; that the proposed granite cladding at the bench and the steps and planters at the eastern stoop of the
north façade will match the color, texture, and profiles of the adjacent granite walls; that the installation of the
proposed granite cladding will not cause damage to, or conceal any significant historic fabric; that the installation
of the proposed molding and internal light fixtures at the canopies will not cause damage to, or conceal any
significant historic fabric; that the discrete lighting fixtures beneath the canopies will not detract from the historic
character of these significant features; that the removal of the wood doors, non-historic lampposts at the West
End Avenue façade, plastic light fixture globes, and garden walkway pavers will not result in damage to or loss of
any significant historic fabric; that the proposed single wood doors at the exterior façades will replicate the details
and appearance of the historic paired doors; that the proposed doors at the courtyard façades will be in keeping
with the configuration, design, and style of doors historically found on the building, and will not be visible from
any public thoroughfare; that the proposed new lampposts at the West End Avenue driveway and new glass
globes atop the remaining historic lampposts will be in keeping with the design and details of historic light
fixtures on the building; that the proposed granite pavers at the garden walkways will harmonize with the color,
texture, and profiles of the granite found at the building; that the proposed garage vents will be installed in the
planting beds of the courtyard garden and will not cause damage to any significant historic material; that the vents
will have a low profile and will not be visible from any public thoroughfare; and that the work will not detract
from the special character of the Apthorp Apartments Individual Landmark. Based on these findings, the
Commission determined the proposed work to be appropriate to the building, and voted to approve the proposal
with modifications.

However, the Commission made its determination subject to the following stipulations: that the conversion of
electric light fixtures to gas be eliminated; that the material, details and roof of the new guardhouse be revised;
that the material and profile of the molding under the canopies more closely match the historic; and that the
proposed granite cobblestone driveway paving be replaced with an asphalt paving similar to the existing; and that
two signed and sealed copies of the Department of Buildings drawings for the approved work be submitted to the
staff of the Commission for review and approval.

Subsequently, the Landmarks Preservation Commission received final drawings A-1 through A-10 dated revised
June 23, 2008 and prepared by Mark Verkhovsky, R.A. Staff reviewed the drawings and found that the work also
includes installing accent light fixtures at the Broadway and West End Avenue façades to illuminate the existing
statues and light fixtures within each archway. Accordingly, staff reviewed the drawings and found that the
installation of the proposed accent light fixtures will not cause damage to, or removal of any significant historic
fabric; that the proposed light fixtures and conduit will not be visible from any public thoroughfare; that the
conversion of electric light fixtures to gas has been eliminated; that the material of the new guardhouse is now
cast aluminum, that additional detail trim has been added, and that the roof is now a solid metal panel; that the
profile of the molding under the canopies has been revised to better match the historic profile; that the granite
cobblestone and herringbone pattern have been eliminated in favor of match the existing paving and pattern; that
the proposed asphalt pavers at the courtyard drives will match the material, size, and pattern of the existing
paving; that the proposal approved by the Commission has been maintained; and that the requirements made by
the Commission have been incorporated into the design. Based on this and the above findings, the drawings have
been marked approved with a perforated seal and Certificate of Appropriateness 09-2969 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed

during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
