Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of September 11, 2007, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for work at the subject premises, as put forward in your application completed on August 16, 2007; and as described in Status Update Letter 08-3177 (LPC 07-1657) issued on September 14, 2007. The proposal, as approved, includes constructing a one-story glass rooftop addition and stair bulkhead at the eastern portion of the roof. The proposal was shown on presentation boards consisting of site plans, current condition photographs, mock-up photographs, renderings, and drawings LPC 1 through LPC 8, dated revised August 27, 2007, prepared by Bentel & Bentel; and all presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the designation report for the Soho-Cast Iron Historic District describes the building as a warehouse designed by Henry Fernbach and built in 1883; and that the building's style, scale, materials and details are among the features that contribute to the special architectural and historic character of the Soho-Cast Iron Historic District. With regard to this proposal, the Commission found that that the proposed work will not cause damage to any significant features of the building; that the small size of the proposed addition will be consistent with the size of rooftop bulkheads found throughout the district and will not overwhelm or significantly alter the character of the building; that the proposed addition will be visible from limited viewpoints on the street at a great distance; that the addition will be viewed in the context of other utilitarian rooftop accretions and against the backdrop of taller buildings behind it and will blend into this surrounding roofscape in a manner consistent with the types of accretions typically found on buildings within the historic district. However, the Commission made its determination subject to the stipulation that two sets of Department of Buildings filing drawings be submitted to the Commission for review and approval. Subsequently, on June 13, 2008, the Commission received drawings A0.0, A0.01, A0.02, A1.0, A1.1, A1.2, A1.3, A1.4, A2.0, A2.1, A2.2, A3.0, A4.0, A4.1, A4.2, A5.0, A5.1, A5.2, A5.3, A6.0, A7.0, A8.0, A8.1, and A8.2, dated revised April 30, 2008, prepared by Frederick R. Bentel, R.A. The Commission reviewed these drawings and found that the work approved by the Commission has been maintained. Based on this and the above findings, the drawings are being marked approved with a perforated seal, and Certificate of Appropriateness 09-1591 is being issued. The drawings also show additional work, including the construction of another one-story glass rooftop addition and the installation of a skylight at the western portion of the roof, neither of which are visible from any public thoroughfare. Staff reviewed this additional work and finds, based on a site inspection of a mock-up, in accordance with the Rules of the City of New York, Title 63, Section 2-19(e); that the construction of the addition, consisting of occupiable space, will not result in any damage to, or demolition of, a significant architectural feature of the roof of the structure on which it is constructed; that the addition will not visible from a public thoroughfare; that the work will not adversely affect significant architectural features of adjacent improvements; and that there are no outstanding objections for use or bulk listed on the objections sheet for such structure; that the proposed skylight installation consists solely of mechanical equipment; that it will not result in damage to, or demolition of, any significant architectural features of the roof of the building; that the equipment will not be visible from any public thoroughfares; and that the installation will not adversely affect any significant architectural features of adjacent improvements. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
