Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of February 26, 2008, following the Public Hearing of the same date, voted to approve certain alterations at the subject premises, as put forward in your application completed on January 10, 2008. The approval will expire on February 26, 2014. The proposed work, as approved, consists of the amendment of Certificate of Appropriateness 93-0030 for the construction of a one-story penthouse addition, including the construction of new mechanical and stair bulkheads at the roof; the modifications of the size, configuration, and fenestration of the addition; the enlargement of window openings at the non-visible rear façade; and the construction of extensions behind the peaked parapets at the roof; as shown in presentation boards H-1A, H-1B, H-2, H-3, A101, A102, A103, A104, A301A, A301B, A302A, A302B, A303, A304, M1, M2, M3, M3A, M3B, M4, M4A, M5, M5A, M5B, M6, M6A, and M6B, dated 2/26/08, prepared by John Hasselbauer, submitted as components of the application, and presented at the February 26, 2008 Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the Claremont Stables designation report describes 175-177 West 89th Street as a Romanesque Revival style carriage house and stable designed by Frank A. Rooke and built in 1892. The Commission further notes that Certificate of Appropriateness 93-0030 was issued on November 4, 1992, for the construction of a one-story penthouse addition; that Miscellaneous/Amendment 00-4027 was issued on January 11, 2000, for the construction of a second, projecting polygonal bay on the roof; the relocation of the approved polygonal bay further south, and the addition of a chimney; and the alteration of the penthouse window shapes and configurations; and that Miscellaneous/Amendment 08-5020 was issued on November 27, 2007, for the construction of an elevator bulkhead near the center of the penthouse addition and for the construction of a stair railing near the center of the penthouse addition. With regard to this proposal, the Commission found that the height and massing of the visible bulkheads will not overwhelm the building or the streetscape; that the proposed rooftop addition will be set back from the front and rear facade, maintaining the original volume of the building; that the proposed addition will not be visible over the primary façade and will primarily be visible from the east over the adjacent small carriage houses in the same way the historic addition was; that the scale of the addition and its location set back from the east wall will neither dominate, nor overwhelm, the building when viewed from the east; that while the proposed addition will be some what different configuration than the approved addition, the overall scale and visibility will remain the same; that the neutral finish of the stucco cladding on the east facade of the rooftop addition will help distinguish the addition from the main building and help the addition recede from view; that the proposed penthouse addition will be of a more utilitarian design than what was previously approved and will more closely recall the historic penthouse addition; that the material, fenestration and details of the addition will be in keeping with the character of rooftop accretions on the building, and will allow it to blend unobtrusively with the roofscape; that the enlarged window openings at the rear facade will not be visible from any public thoroughfare and the modification will not damage or destroy any significant architectural features; and that the extensions from the peaked parapets will strengthen these architectural elements and will be harmonious with the massing of the building. Based on these findings, the Commission determined the proposed work to be appropriate to the Landmark, and voted to approve this application. However, the Commission made its determination subject to the following stipulations: that the western stair bulkhead be relocated and reconfigured on the roof to eliminate its visibility from the public thoroughfare; and that two signed and sealed copies of the Department of Buildings drawings for the approved work be submitted for review and approval. Subsequently, on May 2, 2008 and May 22, 2008, the Landmarks Preservation Commission received final drawings Z001, Z002, Z003, G101, G102, G103, G104, D001, D101, D102, D103, D301, D302, D303, A001, A002, A101, A102, A103, A104, A200, A201, A202, A203, A204, A301, A302, A303, A304, A305, A306, A307, A401, A402, A403, A404, A405, A406, A501, A502, A503, A504, A505, A506, A601, A602, A603, A604, A605, A701, A702, A703, A704, A800, A801, A802, A803, A804, and A900, dated 4/21/08, prepared by Sherida Paulsen, R.A., drawings S100, S101, S102, S103, S104, S200, S201, S202, S203, and S204, dated 4/21/08, prepared by Robert James Murray, P.E., and drawings HP001, H-101, H-102, H-103, H-104, H-105, H-106, H-107, H-108, H-109, H-110, H-111, H-112, H-201, H-202, H-203, H-204, H-205, H-206, H-207, H-208, H-209, H-210, P-101, P-102, P-103, P-104, P-105, P-106, P-107, P-201, P-202, P-203, P-204, P-205, P-206, P-207, P-208, SP-101, SP-104, SP-201, SP-202, SP-203, E-100, E-101, E-102, E-103, E-104, E-105, E-106, E-107, FA-100, FA-101, FA-102, FA-103, and FA-104, dated 4/21/08, prepared by Stanislav Slutsky, P.E. Staff reviewed these drawings and found that the stair bulkhead on the roof has been relocated towards the center of the roof and will no longer be visible from a public thoroughfare; that four of the enlarged openings at the rear façade will remain as existing openings as previously approved in MISC 08-5020 (LPC 08-2642); that the boiler bulkhead at the roof will be reoriented to a north-south direction; that the chimney flue at the roof will be slightly extended; that the extension from the westernmost parapet will be extended further back on the roof; and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-1429 is being issued. Please note that this permit is being issued in conjunction with Certificate of No Effect 09-1428 (LPC 09-1473). This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
