Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of July 22, 2008, following the Public Hearing of the same date, the
Landmarks Preservation Commission voted to legalize a chimney flue installed without Landmarks Preservation
Commission permits, as put forward in your application completed on May 22, 2008.

The proposal as approved, consists of painting the fence enclosing the chimney flue and the adjacent perimeter
fence brown (Benjamin Moore HC-69 "Whitall Brown"). The proposal was shown on two presentation boards
dated as received May 20, 2008, and submitted as components of the application and presented at the Public
Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the Fort Greene Historic District designation report
describes 271 Adelphi Street as an Italianate style rowhouse built in 1871; and that the building's style, scale,
materials, and details are among the features which contribute to the special architectural and historic character of
the Fort Greene Historic District. The Commission further noted that Notice of Violation 03/0548 was issued
March 18, 2003, for the "installation of flue at rear, visible from DeKalb Avenue, without permit(s)."

With regard to this proposal, the Commission found that no significant architectural features of the building were
altered or damaged by the construction of the chimney flue; that the flue is located on a full lot extension to the
building and is therefore located at the furthest distance from the rear façade; that its placement and location do
not call undue attention to this installation; and that painting the enclosure fence a muted brown will minimize the
visual obtrusion. Based on these findings, the Commission found the proposed work to be appropriate to the Fort
Greene Historic District and voted to legalize it.

Please note that Notice of Violation 03/0548 remains in effect against the property, and this permit has been
issued in reliance upon the applicant's demonstrated intention to perform work to correct the violation. Failure to
address this violation may result in the issuance of a second Notice of Violation originating from the
Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7-02(c).
This NOV would require a court appearance and a civil penalty may be imposed and cannot be cured.

Once the corrective work has been performed, please submit photographs, with close-up shots of the completed
work, and a letter from the building owner requesting a Notice of Compliance to the staff of the Commission.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
