Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of July 8, 2008, following the Public Hearing of the same date, voted to
approve a proposal for work at the subject premises, as put forward in your application, completed on June 30,
2008. This approval will expire July 8, 2014.

The proposed work, as approved, consists of removing two non-historic storefronts; installing a new metal,
aluminum and glass storefront infill finished in Benjamin Moore HC-166, including new transom windows with
signage painted-on-glass above doorway transoms, new metal brackets to match existing, new painted colonettes
to be moved to accomodate a widened residential entry door, new stamped painted metal bulkheads at
single-paned display windows and commercial doors; and a new residential entryway with a recessed light above,
single-paned glass door with sidelight and residential intercom. The proposal was shown in historic photographs
and drawings, submitted as components of the application and presented at the Public Hearing.

In review of this proposal, the Commission noted that the Cobble Hill Designation Report describes 138-138A
Court Street as a modern building built between 1915 and 1917; and that in terms of its scale, material and
details, this building contributes to the special architectural and historic features of the Cobble Hill Historic
District.

With regards to this proposal, the Commission found that the installation of the proposed storefront will not result
in any damage to or demolition of significant architectural features of the building; that the existing historic metal
pilasters and cornice at the ground floor will be retained and restored; that the configuration of the proposed
storefronts will recall the design, materials and details of early 20th century storefronts found within this historic
district; that the signage on the transom glass above the door is in keeping with the type of signage historically
found on storefront buildings of this age and style; and that materials and color palette are harmonious with the
rest of the building. Based on these findings, the Commission determined the work to be appropriate to the
building and the historic district and voted to approve this application.

However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the
presentation drawings for the approved work be submitted to the staff of the Commission for review and
approval.

Subsequently, on July 8, 2008, the Landmarks Preservation Commission received final drawings A0.01 through
A0.05, A1.00, A1.01, A1.02, A1.03, A2.01, A2.02, A2.04, A2.05, A3.01, A3.02, A5.01, A6.01, A6.02, and
A7.01 through A7.06, prepared by Martin H. Kapell, R.A. Staff reviewed the drawings and found that the work
approved by the Commission has been maintained. The work also includes, at the exterior, at the rooftop, the
installation of new painted steel railings, new stair bulkhead, new privacy fences, new chimney flue; at the rear
yard, the demolition of a one story addition and the construction of a one story addition with a terrace at the
rooftop finished in stucco; at the front facade, the replacement of all existing windows with nine-over-one double
hung wood windows finished in white, the restorative cleaning of front facade with a dilute acid solution, the
repointing of brick and in-kind replacement of brick, where needed, the restoration of the friezework near the
roofline; at the rear facade, the replacement of all existing windows with one over one double hung aluminum
windows, the demolition of a portions of a masonry wall at the first floor for egress, the installation of two doors
at the second floor in existing masonry openings and the stuccoing of deteriorated brick. Associated interior
work includes, at all levels, the installation of stairways, construction of non-bearing partitions, and the
installation of new mechanical, electric and plumbing systems.

With regard to the additional work, the Commission finds that in accordance with the Rules of the City of New
York, Title 63, Section 2-19 the rooftop additions consist solely of mechanical equipment, does not result in the
damage to, or demolition of, a significant architectural feature of the roof of the structure, is not visible from any
major public thoroughfare, does not adversely affect significant architectural features of adjacent improvements;
that in accordance with the Rules of the City of New York, Title 63, Section 2-16, the rear yard addition will not
extend to the rear lot line or substantially eliminate the prescence of a rear yard, is situated at the rear of the
building that does not have any significant architectural features; is not visible from a public right of way, is also
another rear yard incursion in the block, does not require special permit or variance, does not rise to the full
height of the building, and preserves the rear facade; instead, existing openings are being modified to provide
access into the addition; that in accordance with the Rules of the City of New York, Title 63, Section 3-04, at the
front facade, the new windows will match the configuration, operation, details, materials, and finish of the
historic windows; at the rear non-visible facade, the new windows will be installed in exsiting window openings
and do not replace any special windows. Based on this and the above findings, the drawings are marked
approved with a perforated seal, and Certificate of Appropriateness 09-1584 is being issued.

Please note that this permit is contingent upon the Commission's review and approval of samples prior to the
commencement of work. Please contact Joselito Corpus to schedule a site visit once the sample are available for
review. This permit is also contingent on the understanding that the work will be performed by hand and when
the temperature remains a constant 45 degrees Fahrenheit or above for a 72 hour period from the commencement
of the work.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or

civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
