Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 18, 2008, following the Public Meeting of March 11, 2008, and the Public Hearing and Meeting of February 26, 2008, voted to approve the proposed work at the subject premises, as put forward in your application completed on January 31, 2008, and as you were informed in the Status Update Letter issued on March 18, 2008 (SUL 08-8158, LPC 08-2085). This approval will expire on March 18, 2014. The proposed work, as approved, consists of the removal of and the replacement of signage installed without Landmarks Preservation Commission permits at the Lafayette Street and East Fourth Street façades. The proposal, as originally presented, included installing sidewalk lamp posts, and replacing signage at the glazed openings and legalizing the installation of signage at the lower portion of the larger glazed openings at the second floor at the Lafayette Street façade as is, all without Landmarks Preservation Commission permits, as shown in photographs and drawings dated January 22, 2008, February 26, 2008, and March 11, 2008, prepared by Building Conservation Associates, submitted as components of the application, and presented at the Public Hearing and Public Meetings. In reviewing this proposal, the Commission noted that the DeVinne Press Building Individual Landmark Designation Report describes 393-399 Lafayette Street, also located in the NoHo Historic District, as a Romanesque Revival style printing house designed by Babb, Cook and Willard and built in 1885-86 with a later addition built in 1890-91, and that the building's style, scale, materials and details are among the features that contribute to the special architectural and historic character of the NoHo Historic District. The Commission further noted that Warning Letter 08-0375 was issued on November 15, 2007 for the "installation of Astor Wine & Spirits (red rectangular signage above Lafayette Street storefronts) without permit(s)." With regard to this proposal, the Commission found that the removal of the illegal signage will eliminate a color palette that detracts from the special historic and architectural character of the building, streetscape and historic district; that the translucent white logo signage will be unobtrusive and will create regularity in the larger window openings; that the signage at the lower portion of the larger glazed openings at the Lafayette Street facade will be reduced and will not detract from the significant features found at the base of the building; and that the size, material and placement of the proposed signage will be well-scaled, will maintain the transparency of the windows, and will not call away attention from the noteworthy architectural features of the building. Based on these findings, the Commission determines that the proposed work is appropriate to the building and to the NoHo Historic District, and voted to approve this application. However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on May 30, 2008, the Landmarks Preservation Commission received final revised drawing ("Lafayette Street - Proposed Design") dated March 11, 2008; drawings A-7.1 and A-7.2 dated January 29, 2008, prepared by Tricario Architecture and Design PC; and written correspondence dated May 30, 2008, prepared by Heather McGrath, Building Conservation Associates. Staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-0708 is being issued. Please note that Warning Letter 08-0375 will be rescinded when the work approved under this Certificate of Appropriateness has been completed. Please notify the Landmarks Preservation Commission staff when the work has been completed, and send clear color photographs of the completed work and a letter to the Commission requesting that a Notice of Compliance be issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
