Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of May 20, 2008, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your
application completed April 24, 2008.

The proposed work, as approved, consists of constructing a one-story rooftop addition, with metal cladding,
painted to blend with the surrounding context, at all four facades and a section of brickwork at the eastern facade.
The work was shown on three presentation boards, labeled L1, L2 and L3 by the Commission staff; dated
(presented) May 20, 2008; and consisting of drawings and photographs, all prepared by John Ellis, and presented
at the Public Hearing and Public Meetings.

In reviewing this proposal, the Commission noted that the West End Collegiate Historic District Designation
Report describes 316 West 75th Street as a Renaissance Revival style townhouse, designed by C. P.H. Gilbert
and built in 1895-1897; and that the building's style, scale, materials and details are among the features that
contribute to the special architectural and historic character of the West End Collegiate Historic District.

With regard to this proposal, the Commission found that the construction of the proposed rooftop addition will
not alter, eliminate or conceal any significant protected architectural features of the building; that the addition
will not be visible in conjunction with the building's primary façade or significantly alter the overall scale of the
building; that the addition will only be visible at a distance in the context of taller buildings and rooftop
accretions; that the simple design, massing and materials of the addition will not call undue attention to the
addition or detract from the historic character of the building; that the addition will be painted to blend with the
surrounding buildings, thereby helping it to recede from view; and that the proposed addition will not diminish
the special architectural and historic character of the building or West End Collegiate Historic District. Based on
these findings, the Commission determined the work to be appropriate to the building and the historic district and
voted to approve the application with the stipulation that the existing materials of the building's eastern sidewall
facade be verified and that the cladding materials to be installed at the eastern side of the addition be compatible
with the existing materials of the sidewall.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two sets of signed and sealed Department of Building filing drawings showing the approved design.

Subsequently, on May 27, 2008, the Commission received existing condition photographs of the eastern sidewall
of the building and a final drawing, labeled "Alt. 1 Penthouse #104617522;" dated May 27, 2008; and prepared
by John Malek Ellis, RA.

Accordingly, staff reviewed these materials and noted that they include additional work, consisting of interior
alterations at the fifth floor, as well as documentation of the eastern sidewall, featuring brickwork and corrugated
metal. With regard to these materials, staff found that the proposed brickwork and metal cladding at the eastern
facade will be compatible with the surrounding materials; and that this work will not be visible from any public
thoroughfare. Additionally, staff found that the design approved by the Commission has been maintained. Based
on these and the above findings, the drawings have been marked approved with a perforated seal, and Certificate
of Appropriateness 09-0607 is being issued.

PLEASE NOTE: This permit is issued contingent upon the Commission's review and approval of a field sample
of the proposed finish of the addition prior to the commencement of work. Contact the Commission staff once
the samples are available for inspection.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
