Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of February 5, 2008, following the Public Meeting and Public Hearing of the
same date, voted to approve the proposed work at the subject premises, as put forward in your application
completed January 10, 2008. This approval will expire January 10, 2014.

The proposed work, as approved, consists of the demolition of the existing one-story rear yard extension and the
construction of a full height rear yard additio projecting to the rear lot line at the basement; the installation of an
HVAC unit, and an elevator and stair bulkhead with brick cladding at the roof; and raising the brick side parapet
to meet the front parapet; as shown in existing condition photos and presentation boards labeled A0.00, A1.00,
A1.01, A2.00 through A2.06, A4.01, A4.02, A4.03, A4.04, A4.05, A4.06, A4.10, A4.11. A4.50 through A4.58,
E4.01 through E4.03, P1.00, P1.01, P2.00, P2.01, P3.00, P3.01, P4.00, P4.01, P5.00, P5.01, P6.00, dated October
11, 2007, P6.00, dated September 27, 2008, all prepared by Thomas W. Hut, R.A., submitted as components of
the application, and presented at the Public Hearing.

In reviewing this proposal, the Commission notes that the Upper East Side Historic District designation report
describes that 22 East 72nd Street as a neo-Renaissance style rowhouse designed by Rose & Stone and built in
1893-94. The Commission also notes that this permit is issued in conjunction with Certificate of Appropriateness
08-8205 (LPC 08-6164), issued June 3, 2008 for work at 888 Madison Avenue, and Certificate of No Effect
09-0561 (LPC 09-0570) for restorative work at the primary façade.

With regard to this proposal, the Commission finds that the proposed work will not cause the removal of any
significant architectural features; that the proposed rear yard addition will not be visible from any public
thoroughfare; that the adjacent houses all have full-height rear yard additions and the proposed rear yard addition
will match and align with the additions on the adjacent buildings and will not overwhelm the rear facades of the
adjacent buildings; that the proposed addition is at the end of the block, and partially cut off from the central
greenspace by the large additions on the adjacent building and therefore, will not further diminish the central
green space; that because the building is at the end of the block, adjacent to the proposed full lot building at 888
Madison Avenue and across from a two-story extension that projects close to its rear lot line, the presence of this
full-lot extension, limited to one-story, will not detract from the adjacent buildings or rear yards; and that the
proposed rear façade and fenestration pattern will maintain the scale and character of a rowhouse. Based on these
findings, the Commission determined the proposed work to be appropriate to the building and the historic district,
and voted to approve it.

However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the
presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for
the approved work be submitted to the staff of the Commission for review and approval.

Subsequently, on May 15, 2008, the Landmarks Preservation Commission received final drawings labeled A0.00,
A1.00, A1.01, A1.10, A1.20, A1.21, A2.00 through A2.06, E4.01 through E4.03, P1.00, P1.01, P2.00, P2.01,
P3.00, P3.01, P4.00, P4.01, P5.00, P8.00, dated January 24, 2008, A4.01, A4.01B, A4.02, A4.02B, A4.03,
A4.03B, A4.04, A4.05, A4.06, A4.10, A4.11, A4.50 through A4.58, dated May 14, 2008, prepared by Thomas
W. Hut. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has
been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal,
and Certificate of Appropriateness 08-8205 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
