Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of June 6, 2008, following the Public Meeting of the same date, voted to approve a proposal for work at the subject premises, as put forward in your application completed on March 10, 2008, and as you were informed in Status Update Letter 08-0964 (LPC 08-6743), issued on June 16, 2008. This approval will expire June 6, 2014. The proposed work, as approved, at the penthouse, consists of cladding the existing brick with stucco; at the south elevation, reconstructing an aluminum and glass greenhouse and creating a masonry opening for the installation of one (1) metal, eight-light casement window; at the east elevation, installing one pair (1) of multi-light French metal doors with sidelights and one (1) metal, four-light casement window; and, at the west elevation, installing one pair (1) of multi-light French metal doors with sidelights and one (1) metal, four-light casement window. This proposal was shown in drawings F1.0, F2.0, F3.0, F6.0, F7.0, LPC-1, LPC-2, dated April 17, 2008, prepared by David Richard Hottenroth, R.A., submitted as components to this application and presented at the Public Meeting. In reviewing the proposal, the Commission noted that the Upper East Side Historic District Designation Report describes 760 Park Avenue as a neo-Renaissance apartment building, designed by W.L. Rouse and L.A. Goldstone and built in 1923-24; and that in terms of its style, scale, materials and details, the building contributes to the special architectural and historic character for which the Upper East Side Historic District was designated. With regards to this proposal, the Commission found that the proposed stucco cladding is a common treatment for penthouses of this type on large residential buildings; that the proposed fenestration at the eastern elevation will complement the building's tripartite fenestration; that the addition of the divided light window and the reglazing of the greenhouse will reinforce the relationship between the addition and the entire building; and that the new windows at the western secondary elevation will be set into an already irregular pattern of windows, and will not further disrupt the penthouses' relationship to the building below. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve this application. However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on June 6, 2008, the Landmarks Preservation Commission received final drawings F-0.0 through F-3.0, F-6.0, F-7.0, LPC-1 thorugh LPC-3, issued April 17, 2008, prepared by David Richard Hottenroth, R.A., Staff reviewed the drawings and found that the work by the Commission has been maintained. The work also includes at the 12th floor, the installation of a staircase to the penthouse; at the penthouse, the restoration of windows at the solarium; at the penthouse roof level, the closure of one skylight; the removal of an existing flue and its placement near the existing solarium; and a new gas vent. With regard to this additional work, staff finds, in accordance with the Rules of the City of New York, Title 63, Section 2-19, that the mechanical equipment will not result in damage to, or demolition of, a significant architectural feature of the roof; is minimally visible from a public thoroughfare; and does not adversely affect significant architectural features of adjacent improvements. Also, in accordance with the provisions set forth in Title 63 of the Rules of the City of New York, Section 2-17(c), that the restorative work on the penthouse windows is based upon existing physical evidence on the building, that the restoration will return these significant elements to their historic appearance. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-0956 is being issued. This permit is contingent upon the Commission's review and approval of samples of stucco and paint finishes. Please contact Joselito H. Corpus to schedule a site visit once samples are available for review. This permit is also contingent upon the understanding that the work will be performed when the temperature remains a constant 45 degrees Fahrenheit or above for a 72 hour period from the commencement of work. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to Joselito Corpus.
