| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of April 15, 2008, following the Public Hearing of October 9, 2007, voted to approve a proposal for work at the subject premises, as put forward in your application completed on April 3, 2008, and as you were informed in the Status Update Letter 08-9880 (LPC 07-0816). This approval will expire April 15, 2008. The proposal, as approved, consists of a 10' 4" high rooftop bulkhead, featuring single-paned glass, tongue and groove cedar cladding, and stucco exterior. This proposal was shown in drawings D1.11, D1.12, A1.11, A1.12, A6.11, A6.12, and A6.13 dated May 02, 2007, prepared by Michael Zenreich, R.A., submitted as components to this application and presented at the Public Meeting. The original proposal was for a 11' 4" bulkhead with a fence around the perimeter of the roof. In reviewing this proposal, the Commission noted that the Tribeca West Historic District Designation Report states that 140 West Broadway is a five-story, masonry and cast-iron, Italianate/neo-Grec style store and loft building designed by Carl Pfeiffer and built in 1866.; and that the age, style, scale, materials, and details of the upper two floors are among the significant features of the building which contribute to the architectural and historic character of the Tribeca West Historic District. With regards to this proposal the Commission found that the presence of a small, minimally visible, ultiliarian bulkhead will be in keeping with the types of rooftop accretions typically found in the district; that the new chimney and stair bulkhead will be minimally visible over the secondary facades of the buidlings along West Broadway; that while the proposed bulkhead will be visible over the facades of the buidlings along West Broadway, it will be seen in context of the Western Union Building across Thomas Street and will blend with the roofscape; that the scale, massing and materials of the new bulkhead are typical of other stair bulkheads within the Tribeca West Historic District; and that the work will not diminish the special character of the historic distrct. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve this application. However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on June 4, 2008, the Landmarks Preservation Commission received final drawings D1.11, D1.12, A1.11, A1.12, A6.11, A6.12, A6.13, prepared by Michael Zeinrich, R.A., dated May 02, 2008. Staff reviewed the drawings and found that the work approved by the Commission has been maintained. The work also includes interior alterations, at the fifth floor, the removal of roof framing and the construction of a wood and metal stairway to the rooftop; the construction of new kitchen and bathrooms; and the installation of new plumbing system. Based on this and the above findings, the drawings are marked approved with a perforated seal, and the Certificate of Appropriateness 09-1098 is being issued. Please note that this permit is also contingent upon the understanding that the work will be performed when the temperature remains a constant 45 degrees Fahrenheit or above for a 72 hour period from the commencement of work. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
