Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 18, 2003, following the Public Hearings and Public Meetings of May 28, 2002 and June 4, 2002, the Landmarks Preservation Commission voted to approve certain work at the subject premises, as put forth in your application completed on April 24, 2002, as you were informed in a Status Update Letter dated March 19, 2003. This approval expires March 18, 2009. The Commission voted to approve alterations to the ground floor street facade, including the removal of the existing main entrance, in the eastern-most bay, and the secondary entrance in the western-most bay, the construction of a new main entrance created by combining the two central bays, and the installation of masonry infill at the eastern and western bays where the entrances were removed, with a stone water-table, red brick cladding, a pair of wood and glass doors at the entrance, and eight-over-eight windows, matching the materials and details of the existing ground floor; the construction of a three-story rooftop addition, set behind the parapet, and the removal of the existing rear facade and construction of a rear yard addition, partially visible from East 71st Street, including excavating the rear yard to construct a sunken garden area at the basement level, , as shown in existing and proposed site plans, floor plans, sections, and elevations, photographs of the existing property, photographs of a mock-up constructed on site, and photo-montages, all prepared by Costas Kondylis and Partners LLP Architects, and presented at the Public Hearings and Public Meetings. In reviewing this proposal, the Commission noted that the designation report describes 40 East 72nd Street as a pair of rowhouses built in 1881 and remodeled as a neo-Classical style five story apartment building in 1928 by Schwartz and Gross; and that the building's style, scale, materials, and details are among the features which contribute to the special architectural and historic character of the Upper East Side Historic District. With regard to this proposal, the Commission found that that the proposed alterations to the ground floor will not eliminate any significant architectural features of the building; that relocating the main entrance doors to the center of the facade will unify the building and will be compatible with the style and symmetry of the building; that the materials and details of the proposed ground floor alterations will be in keeping with the upper stories of the building and compatible with the architectural features of the building and the surrounding streetscape; that construction of the proposed rooftop addition will not eliminate any significant architectural features of the building; that the dark finish and simple detailing of the metal cladding and windows of the proposed rooftop addition will help it to blend with the roof-scape; that the visibility of the proposed rooftop addition will not cause it call undue attention to itself or to detract from the significant architectural features of the building or the surrounding streetscape, because the addition has been designed with materials, finishes and details which allow it to blend with the building's facades and with setbacks and massing that allow it to be subordinate to the two buildings on either side; that the proposed demolition of the rear facade will not cause the destruction of any significant architectural features of the building; that the design, composition and details of the proposed rear facade will be in keeping with the character of small modern apartment buildings in this historic district; that only a small portion of the proposed rear facade will be visible through an alley on East 73rd Street, and then in context with other large apartment building facades, thereby minimizing its impact upon the streetscape and the Upper East Side Historic District; and that for these reasons the proposed alterations are in keeping with the building, the street, and the Upper East Side Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building, and voted to approve it. However, the Commission made its determination subject to the stipulation that two sets of signed and sealed drawings which are to be filed at the Department of Building be submitted to the Commission for review and approval. On June 6, 2008, staff received drawings Z-1, A-001, A-002, A-100 through A-105, A-300 through A-303, A-400, A-401, A-500, A-600, A-601, ID-220, ID-220A, ID-150.1, ID-150-2, ID-150-3, ID-151, ID-151.1, ID-160.1 through ID-160.8, ID-161, ID-161.1, ID-161.2, ID-161.3, ID-161.4, E-100 through E106, M-101 through M-109, P-100 through P-105, P-201 through P205, P-301 through P-303, P-401, F-100, F-101, FP-102, FP-103, FP-104, and a cover sheet, all dated June 6, 2008, and SD-1, dated June 2, 2008, and S-1 through S-7, all dated May 20, 2008, all prepared and submitted by Costas Kondylis and Partners LLP. Staff has reviewed these materials, and noted modifications to the approved design, including, on the 72nd Street facade, on the ground floor replacing the approved eight-over-eight window and masonry infill in the western-most bay with a new wood and glass door, and modifications to the masonry infill; the addition of transoms to the approved French doors on the 7th and 8th floors; on the 8th floor, changing the layout of the approved French doors; at the roof, adding a chimney, set back from the northern parapet; at the secondary south-facing facade, adding transoms to the French doors and casement windows; and also at the south facade, eliminating the sunken courtyard. The floor plans have also been altered to reflect these proposed changes. Staff has reviewed these changes to the approved design and determined that none of the proposed modifications will result in the elimination of any significant protected historic material; that the design of the new door at the secondary entrance is in keeping with the design of the approved doors at the main entrance, helping to reinforce the unity of the street facade; that because the approved setbacks have been maintained at the rooftop addition, the addition of transoms at the French doors at the 7th and 8th floors, the change of locations of the door openings at the 8th floor, and the addition of the chimney, will have minimal impact on the perception of the addition; that the door openings on the 8th floor will retain the symmetry which helps the design of the addition relate to the design of the historic facade; that the addition of transoms at the windows and French doors on the partially visible secondary facade will reinforce the character of this small-scaled apartment building; and that eliminating the sunken courtyard, which would not have been visible from any public location, will have no effect upon the appearance of this secondary facade. Based on these findings, staff has determined that the final proposal maintains the design approved by the Commission. Therefore, these drawings are being marked approved with a perforated seal, and Certificate of Appropriateness 09-0761 is being issued. The approved work is limited to that described above. Please retain and clean samples of the existing brick, the stone water-table, and the mortar from the front facade for use in selecting new materials, prepare sample patches showing the proposed masonry units and mortar, and notify the Commission to arrange for an inspection of the PAGE 2 Issued: 6/18/08 DOCKET: 09-0603 proposed materials to determine if they match the original, prior to ordering materials or completing the final phases of the facade work. Please also provide samples for the proposed metal cladding for the addition, and the proposed paint for the windows, and the proposed paint for the doors facing East 72nd Street to the staff for review and approval prior to ordering or installing these materials. This permit is issued with the understanding that the masonry work will take place when the temperature remains a constant 45 degrees Fahrenheit for 72 consecutive hours. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to John Graham. Robert B.
