Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of November 14, 2006 following the Public Hearing and Public Meeting of
October 31, 2006, voted to grant a Certificate of Appropriateness for installation of new windows at the subject
premises, as put forward in your application completed on October 5, 2006, and as you were notified in Status
Update Letter 07-3623 (LPC 07-2414) issued on Nobember 15, 2006. The approval will expire on November 14,
2012.

The proposal, as approved, consists of the removal of the existing wood windows at the upper floors and the
installation of new tri-partite aluminum windows with fixed panes flanked by new aluminum single-paned tilt and
turn windows, as shown in presentation boards labeled A, B, C, and 1 through 10, dated September 25, 2006,
prepared by Architecture Unlimited, and presented at the Public Hearing and Public Meetings.

In reviewing this proposal, the Commission noted that the Ladies' Mile Historic District Designation Report states
125 Fifth is a neo-Gothic style dwelling built circa 1850-51, and altered circa 1921-23, by Irving Margon; and
that the building's style, scale, materials and details are among the features that contribute to the special
architectural and historic character of the Ladies' Mile Historic District. The Commission also noted that original
window configuration consisted of fixed single-paned wood central display windows and flanking pivot
windows, and that the upper floors of the building were damaged in a recent fire.

With regard to this proposal, the Commission found that the proposed aluminum windows will match the
configuration and framing profiles of the historic wood windows; that the proposed finish will be based on a paint
analysis of the historic wood windows; that given the refined details and finish of the proposed windows, the
change in material, from wood to aluminum, the change in the operation from pivot to tilt-and-turn, and the
presence of a butt-joint backed by a framing member in the center of the large fixed panes, will not result in the
diminishment of the historic character of the facade; and that the installation of new windows will bring the
building closer to its historic appearance. Based on these findings, the Commission determined the proposed work
to be appropriate to the building and the Ladies' Mile Historic District, and voted to approve this application.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two sets of signed and sealed Department of Building filing drawings showing the approved design.

Subsequently, on May 30, 2008, the Landmarks Preservation Commission received final drawings labeled,
A2.01, A5.02, dated August 10, 2007, and prepared by Stephen Hruby, R.A.; and 125-1-S-1A (dated 1/11/08);
125-S-2B (dated 3/26/08); 125-20B, 125-12A through 125-28A (dated 10/17/07); 125-1A, 125-7A, 125-10
(dated 8/6/07); 125-2A, 125-3 (dated 8/24/07); 125-4A (dated 8/1/07); 125-5, 125-6A (dated 7/26/07); 125-8A
(dated 7/27/07); 125-9A (dated 7/30/07); 125-11A (dated 8/22/07); 125-S.29, 125-S.37, 125-S.38 (dated 1/9/08);
and 125-S.30, and 125-S.31 through 125-S.36 (dated 1/14/08); prepared by Boston Valley Terra Cotta.
Accordingly, staff reviewed the drawings and found that the proposal had been updated to include a blue-green (
Benjamin Moore's "Salamander") finish color for the windows, and includes additional work, consisting of
replacement of fire damaged terra-cotta tiles at the base of the building, and at the upper floors of the
northern-most half of the building; and pointing all of the new and existing terra cotta tiles. With regard to this
work, the Commission finds, that the window finish color was based on a paint analysis performed by Jablonski
Berkowitz Conservation, which determined that the windows were most frequently painted a blue-green color
over the course of their lifetime; that the replacement terra-cotta tiles will match the existing terra-cotta tiles with
respect to color, texture, thickness, and detail; and that the pointing mortar will match the historic pointing
mortar with respect to color, composition, texture, and tooling. Additionally, staff finds that the design approved
by the Commission has been maintained. Based on this and the above findings, the drawings have been marked
approved with a perforated seal, and Certificate of Appropriateness 09-0877 is being issued.

PLEASE NOTE: This permit is issued contingent upon the Commission's review and approval of samples of the
terra-cotta tiles and pointing mortar prior to the commencement of the work; and the understanding that the work
will take place when the exterior temperature remains a constant 45 degrees F or above for a 72-hour period from
the commencement of the work. Please contact Andria Darby at the Landmarks Preservation Commission when
samples are completed for a site inspection.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
