Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of January 15, 2008, following the Public Hearing and Public Meeting of November 13, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on October 18, 2007. The proposal, as approved, consists of alterations to the facade on the lower two floors of the West 42nd Street side of the building, including the removal of the modern polished granite cladding and string course below the second floor windows, the modern ground floor infill, including the entrance to the main lobby, the storefront infill in the eastern and central bays, and the interior security grilles, retaining the metal service doors on the east and west sides of the building, and the removal of the modern windows at the second floor; the installation of new granite base and new limestone cladding at the four piers at the ground floor, featuring limestone cladding adjacent to the three ground floor openings detailed with fluted ribs matching those still in place on the second and third floors; the addition of a string course at the lower edge of the spandrel panel between the second and third floor windows; the installation of new two-story storefront infill, featuring bronze framing, bronze clad spandrel panels with molded detailing, a projecting bay in the central opening, and the street address and name of the tenant at the spandrel panel; and repainting the service doors and frames to match the color of the historic limestone cladding; and related interior alterations, as shown in drawing A-405, showing a rendeering of the proposed elevation of the lower three floors, sections, and floor plans, and a rendered axinometric drawing of the lower three floors, all prepared and presented at the Public Hearings and Public Meeting by Perkins Eastman Architects LLP. As originally presented at the November 13, 2007 Public Hearing, in drawings titled "Entrance Existing Elevation", "Entrance Section View", Entrance Section View", showing a detail section, "Plan View", "Plan Ground View", "Lobby", and "Proposed Elevation", and in photographs titled "130 West 42nd Street Location", "Current Entrance View", and "Historical Entrance View", the storefront framing had minimal detailing; the infill at the central bay did not have a spandrel panel; the two spandrel panels at the flanking bays were also minimally detailed; and the spandrel panel between the second and third floors did not have the addition of the stone string course. In reviewing this proposal, the Commission noted that the designation report for this individual landmark states that Bush Tower is a neo-Gothic commercial building designed by Helmle and Corbett and built in 1916-18; that the building has street facades on both West 41st and West 42nd Streets; and that the West 42nd Street side is the most fully developed facade. The Commission also noted that historic photographs show that when the building was constructed, the lower two floors of the West 42nd Street facade were recessed behind the two central piers, creating a two-story tall covered arcade with the main entrance set back from the street-wall; that the building had a stone water table set below limestone cladding with a ribbed detail at the corneres; that the historic arcade was enclosed prior to designation by the addition of spandrel panels and a floor slab adjoining the existing second floor; and that the work prior to designation also included installing a new main entrance, storefront infill, and granite cladding on the ground floor, and new windows at the second floor, all set into the plane of the street wall. With regard to this proposal, the Commission found that the proposal will not require removing any significant historic building fabric; that replacing the existing modern granite cladding at the base with a new granite water table and extending the limestone piers to the new water table will restore these significant features and bring the building closer to its original appearance; that the new display windows and doors will maintain the symmetry of the façade; that the simple detailing and framing of the proposed windows and doors will not draw undue attention away from these additions to the façade; that the proposed location of new signage at the signband will recall historic signage found on many buildings of this age and type throughout the city; that the decorative detailing on the signband and spandrel will recall the historic detailing still in place on this façade, and seen in the historic photographs of the lower floors of the building, helping to unify this facade; and that replacing the existing modern granite cladding at the piers with a new granite water table and new limestone cladding will bring the building closer to its original appearance. Based on these findings, the Commission determined the proposed work to be appropriate to the building, and voted to approve it. However, In voting to grant this approval, the Commission made its determination subject to the conditions that the applicant work wioth staff to eliminate the angled foot-print of the central bay and simplify the framing of the doors to allow greater transparency at the ground floor; and that two sets of signed and sealed Department of Building filing drawings for the approved work be submitted to the Commission for review. On May 14, 2008, the Commission received drawings A001, A002, AD-101, A-101, A-102, A201, A-202, A-301, A-401, A-402, A-501, A-701, and A-801, all dated January 9, 2008, prepared and submitted by Perkins Eastman Architects. Staff has reviewed these materials and finds that the proposal approved by the Commission, as modified at the Public Meeting, has been maintained in the drawings. Based on these drawings and the approved findings, Certificate of Appropriateness 09-0457 is being issued. The approved work is limited to that described above. Please submit the storefront shop drawings,showing the detailed profile of the framing members, to the staff of the Commission for review and approval prior to ordering the storefront framing or completing the final installation. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
