Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of May 13, 2008, following the Public Hearing of November 13, 2007, voted
to approve a proposal for work at the subject premises, as put forward in your application completed on April 17,
2008, and as you were informed in Status Update Letter 08-9903 issued on May 15, 2008 (LPC 07-8730). This
approval will expire May 13, 2014.

The proposed work, as approved, consists of the installation a new non-illuminated bronze display case attached
to the façade at masonry joints at the ground floor entrance, a bronze plaque ("Goethe - Institut") attached to the
façade at existing anchor points at the ground floor entrance, and one new flagpole with banner and armature
attached to the masonry sill behind the decorative metal balcony railing at the 2nd floor; and the removal of the
existing sidewalk kiosk and banner armatures attached to the façade, all installed without Landmarks Preservation
Commission permits. The proposal, as originally presented, called for the installation on a new sidewalk kiosk, a
wall-mounted stretch banner and two flagpoles. The proposal was shown in existing condition photographs and
presentation drawings dated November 13, 2007 and May 13, 2008, prepared by Erkan Emre, submitted as
components of the application and presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the Metropolitan Museum Historic District Designation
Report describes 1014 Fifth Avenue as a Beaux-Arts style townhouse designed by Welch, Smith and Provot and
built in 1906-07; and that in terms of its style, scale, materials, and details, it contributes to the special
architectural and historic character for which the Metropolitan Museum Historic District was designated. The
Commission also noted that Notice of Violation 96-0502 was issued on April 24, 1996, for "Installation of
free-standing sign board ("Goethe House") on sidewalk in front of building without permit(s);" and that Notice of
Violation 97-0424 was issued on January 3, 1997, for "Installation of banner armature at 4th floor and hanging
banner without permit(s)."
With regard to this proposal, the Commission found that the removal of the existing kiosk and banner armatures
will eliminate unsympathetic installations that detract from the architectural features of the building and
streetscape, without causing the removal of any historic fabric; that there is precedent for display cases, plaques
and flagpoles with banners on institutional buildings of this age and style in this historic district; that the
installation of the flagpole behind the decorative ironwork and centered above the primary entrance, will
minimize its impact on the façade and will not overwhelm the building; that the installation of the bronze display
case will attach to the masonry façade at mortar joints, and will not cause damage to the façade; and that the
proposed plaque and display case on each side of the primary entrance are of a modest scale and will fit neatly
within the stone courses in the masonry piers, minimizing the impact on the façade at the formal Fifth Avenue
entrance. Based on these findings, the Commission determined the proposed work to be appropriate to the
building and the historic district, and voted to approve this application.

However, in voting to grant this approval, the Commission stipulated that two final signed and sealed copies of
the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission
for review and approval.

Subsequently, on May 21, 2008, the Landmarks Preservation Commission received a manufacturer's cut sheet
and revised final drawings "Proposed Show Case and Identity Plaque" and "Proposed Flagpole," dated 5/13/08,
prepared by Erkan Emre. Staff reviewed the drawings and found that the work approved by the Commission has
been maintained. The work also includes modifying the existing decorative metal window railings to be operable
by installing hardware into the stone jambs at existing attachment points at four (4) window openings on the 4th
and 5th floors at the Fifth Avenue façade. With regard to this additional work, staff finds that the work will not
result in damage to or loss of any significant historic fabric; and that the work will not detract from the special
architectural or historic character of the building or district. Based on this and the above findings, the drawings
are marked approved with a perforated seal, and Certificate of Appropriateness 09-0722 (LPC 09-0707) is being
issued.

Please note that Notice of Violation 96-0502 and Notice of Violation 97-0424 remains in force against the
property. Failure to address this violation will result in the issuance of a second Notice of Violation originating
from the Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section
7-02(c). This NOV would require a court appearance, and a civil penalty may be imposed and cannot be cured.

Once the corrective work has been performed, please submit photographs, with close-up shots of the completed
work, and a letter from the building owner requesting a Notice of Compliance to the staff of the Commission.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
