Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of May 20, 2008, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on April 24, 2008. The work, as approved, consists of enlarging two fixed single-pane windows on the ground floor on the north façade of the building, at the rear of the garden facing East 9th Street, by removing the stainless steel clad window frame and sill, and the portion of the white brick façade directly below the windows, maintaining the existing width and head of the windows, and installing a new matching stainless steel frame, and sill in a lower position, as shown in five boards, all dated May 20, 2008, showing the Site Plan, the Brevoort East Lobby Floor Plan, Existing Elevation, Proposed Elevation, and a Section Detail, and photographs of the existing conditions, including photographs of the street elevations, of the garden and lobby looking from the sidewalk, of the existing windows, and a portion of the elevation directly above the windows, all prepared and presented at the Public Hearing and the Public Meeting by the Architecture Research Office. In reviewing this proposal, the Commission noted that the Greenwich Village Historic District Designation Report describes this building as an apartment house built in 1965. The Commission also noted that this building is not one of the buildings for which the Greenwich Village Historic District was designated; that the residential lobby faces East 9th Street; that the garden is an original feature of the building; that there are windows in the lobby which face two sides of the garden, looking north and also west; that the existing windows are at the rear of the garden, 61 feet back from the public sidewalk; and that the garden is separated from the public sidewalk by a low wall, approximately 24" high. With regard to this proposal, the Commission found that the removal of the simple window frames and sills, and the plain brick panels under the sills, will not destroy any significant historic fabric; that retaining the width of the existing window openings and their alignment with the windows on the upper floors in these bays will maintain the unity of this façade; that matching the details of the existing window frames, sills and brick cladding at the modified windows will retain the overall character of this portion of the façade; that the location of these two windows, set back from the public sidewalk at the rear of the garden, will minimize the visibility of the area of work; and that for these reasons work will not detract from the building, the streetscape, and the Greenwich Village Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building, and voted to approve it. The Commission authorized the issuance of the Certificate of Appropriateness upon receipt and review of two sets of signed and sealed Department of Building construction drawings showing the approved design. On May 21, 2007, the staff of the Commission received the requested drawings, A0.00, A1.00, A2.00, and A3.02, all dated March 25, 2008, prepared by the Architecture Research Office. Staff has reviewed these materials and finds that the proposal approved by the Commissioners has been maintained in the filing drawings. Based on this and the above findings, these drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 09-0127 is being issued. The approved work is limited to that described above. Please retain and clean samples of the existing window frame, brick, and mortar for use in selecting new materials, prepare sample patches showing the proposed brick and mortar, and notify the Commission to arrange for an inspection of the proposed materials to determine if they match the original, prior to ordering materials or completing the final phases of the facade work. This permit is issued with the understanding that the work will take place when the temperature remains a constant 45 degrees Fahrenheit for 72 consecutive hours. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to John Graham. Robert B.
