Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of December 11, 2007, following the Public Hearing and Public Meeting,
voted to grant a Certificate of Appropriateness approving the installation of new storefront infill at the subject
premises; as put forth in your application completed on November 15, 2007. This permit will expire on December
11, 2013.

The work, as approved, consists of installing a new copper cornice above the storefront based on an extant
example on an adjoining building; removing the existing non-historic storefronts and installing new steel, wood,
and glass infill on a concrete curb; and installing non-illuminated, 12" tall, pin-mounted, aluminum letters reading
"F-INTERNATIONAL" in the sign band. This work was shown in photo boards, renderings, and drawings 1
through 6, dated April 11, 2007, revised September, 2007, prepared by Bone/Levine Architects, and submitted as
components of the application, and presented at the Public Hearing and Public Meetings. The proposal, as
originally presented, called for installing a new flagpole and banner; and a narrower transom bar.

In reviewing this proposal, the Commission noted that the SoHo/Cast Iron Historic District designation report
describes 496 Broadway as an Italianate style store and loft building built in 1866; and that in terms of its style,
scale, materials, design, and details the building contributes to the special architectural and historic character of
the SoHo/Cast Iron Historic District. The Commission also noted that Warning Letter (WL) 02-0086 was issued
August 3, 2001, for, "Installation of shopfront, security roll-down gates with exterior housing and awning ("Think
SOHO") without permit(s);" WL 02-0087 was issued August 3, 2001, for, "Alterations to northern-most ground
floor entrance, including installation of security gate, without permit(s);" WL 02-0088 was issued August 3,
2001, for, "Painting facade without permit(s);" WL 02-0089 was issued August 3, 2001, for, "Replacement of
windows at 2nd, 3rd and 5th floors without permit(s);" and WL 03-0848 was issued April 17, 2003, for
"Alterations to shopfront and installation of awning ("So Good") without permit(s)," remain in effect against the
property.

With regard to this proposal, the Commission found that the new cornice above the storefront will be well scaled
to the building and will not result in the removal of significant building fabric; that the removal of the existing
storefront will not cause the removal of historic fabric or significant building fabric that may have been added
over time; that the new storefront will retain the historic cast iron piers and the new infill will fit within the
openings framed by these piers; that the new storefront infill will increase the transparency of the ground floor,
which is a characteristic feature of storefronts in this historic district; that the configuration of the storefront infill,
including bulkhead, display window, and transom, are in keeping with storefronts historically found on building
of this age and style within the historic district; and that the signage, consisting of pin-mounted letters within the
sign band and vinyl letters applied to the glass of the transom above the entry, will be well scaled to the building,
will be located within the signband and will not damage, destroy, or obscure significant architectural features of
the building. Based on these findings, the Commission determined the proposed work to be appropriate to the
building and voted to approve it.

However, in voting to grant this approval, the Commission made its determination subject to the stipulation that
the proposed flagpole and banner be replaced with a bracket sign affixed to the storefront infill; that the transom
bar have larger dimensions; and that two sets of final signed and sealed drawings, showing the approved work,
which are to be filed at the Department of Buildings, be submitted to the staff of the Commission for review and
approval.

Subsequently, on April 30, 2008, the staff of the Commission received drawings 1 through 6, dated April 11,
2007, revised April 20, 2008, prepared by Kevin Bone, R.A. The Commission staff noted that the drawings
included additional work, including, installing a separate retail entrance in the south most bay that matches the
approved entrance in the north most bay and additional 6" high vinyl signage reading "F-INTERNATIONAL"
affixed to the glass of the transom; and installing a new metal bracket sign reading "F-INTERNATIONAL"
affixed to the storefront infill. With regard to the additional work, the Commission found that the proposed entry
door at the southmost bay is in keeping with the original proposed; and that the bracket sign will be attached to
the modern wood storefront infill; that the armature of the bracket sign will be painted black and is simply
designed; that the bracket sign will not exceed 24 inches by 36 inches; and that no historic materials will be
damaged by the installation of the signs. The Commission reviewed the submitted drawings and found that the
proposal approved by the Commission has been maintained. Therefore, these drawings are being marked
approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued.

Please note, this permit is being issued in conjunction with CNE 08-9637 (LPC 08-8538) issued April 7, 2008.

Please also note that WLs 02-0086, 02-0087, 02-0088, 02-0089, and 03-0848, all remain in effect against the
property; and that 02-0086, 02-0087, 02-0088, 02-0089, and 03-0848, will be rescinded when the work approved
under this Certificate of Appropriateness and Certificate of No Effect 08-9637 (LPC 08-8538) has been
completed. Please notify the Landmarks Preservation Commission staff when the work has been completed, and
send clear color photographs of the completed work and a letter to the Commission requesting that a Notice of
Compliance be issued.

PLEASE ALSO NOTE THAT THIS PERMIT CONTAINS A COMPLIANCE DATE OF January 31, 2009.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to

this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
