Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of June 4, 2002, following the Public Hearing of the same date, voted to
approve the proposed work at the subject premises, as put forward in your application completed on May 2, 2002,
and as you were informed in the Status Update Letter issued on June 4, 2002 (SUL 02-6901, LPC 02-5312). This
approval will expire on June 6, 2011.

The proposed work, as approved, consists of removing three non-historic metal and glass greenhouse additions
and constructing three new brick-clad rooftop additions at the penthouse, with precast and existing terra cotta
coping stones and featuring aluminum windows; as shown in drawings A0 dated June 3, 2002; A0.01, A1.01,
A1.02, A1.03, A2 and A2.1 dated May 13, 2002; and A1, A3 through A6 dated March 11, 2002, prepared by
Walter B. Melvin Architects, LLC, submitted as components of the application, and presented at the Public
Hearing.

In reviewing this proposal, the Commission noted that the Upper East Side Historic District Designation Report
describes 791 Park Avenue as a Classicizing Art Deco style apartment building designed by George and Edward
Blum and constructed in 1924-25; and that the building's style, scale, materials and details are among the features
that contribute to the special architectural and historic character of the Upper East Side Historic District.

With regard to this proposal, the Commission found that the removal of the three existing modern greenhouses at
the penthouse, visible from a variety of viewpoints on the street, will not result in the loss of any significant
architectural features of the building; that the construction of the three new one-story additions at the same
locations and heights with similar massing as the existing greenhouses, as well as cladding the new greenhouses
in brick to match the historic brick of the building, will help to make the additions less visible than the existing
additions; and that the simple design, massing and setback locations of the proposed additions will not call undue
attention to the additions or detract from the historic character of the building. Based on these findings, the
Commission determined that the proposed work is appropriate to the building and to the Upper East Side Historic
District, and voted to approve this application.

However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the
presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for
the approved work be submitted to the staff of the Commission for review and approval.

Subsequently, on March 11, 2008, the Landmarks Preservation Commission received final drawings A-1 through
A-6 dated March 5, 2008 and a letter to the Landmarks Preservation Commission for a thirty-six month
extension, prepared by Michael David Berzak, RA. Accordingly, staff reviewed the drawings and the request for
an extension, and found that the work also included interior alterations at the penthouse, including the demolition
and construction of non-bearing partitions. With regard to the additional work and request, the Commission
found that the interior alterations will have no effect on the significant architectural features of the building, and
in accordance with the provisions of Title 63, of the RCNY, Section 7-03, that the request for renewal of the
Status Update Letter has been made prior to the expiration of the original permit; that there are no notice of
violations in effect against the building; and that the proposal approved by the Commission has been maintained.
Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of
Appropriateness 08-9974 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
