Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of April 22, 2008, following the Public Hearing of the same date, voted to
approve a proposal for certain work at the subject premises, as put forward in your application completed on
March 20, 2008.

The proposal, as approved, consists of legalizing the installation of two flagpoles at the West 24th Street façade,
located between the first and second floors flanking the building's main entryway; and legalizing the installation
of two flagpoles at the West 23rd Street façade located on piers flanking the entrance all without permits from the
Landmarks Preservation Commission; as shown in existing conditions photographs, and drawings labeled A1 and
A2, dated February 13, 2008, prepared by William F. Savino, R.A.; submitted as components of the application,
and presented at the Public Meeting and Public Hearing.

In reviewing this proposal, the Commission notes that the Ladies' Mile Historic District designation report
describes 71 West 23rd Street as a neo-Renaissance style loft building built in 1911-12 designed by Harry P.
Knowles; and that the building's style, scale, materials and details are among the features that contribute to the
special architectural and historic character of the Ladies' Mile Historic District. The Commission further notes
that that Warning Letter 08/0640 was issued on January 16, 2008 for the "Installation of flagpoles at West 23rd
Street and West 24th Street entrances without permit(s)."

With regard to this proposal, the Commission found that the installation of the flagpoles has not caused any
damage to significant decorative features of the facade; that West 23rd Street and West 24th Street facades of the
building are not seen together thus the four flagpoles are never seen in conjunction with each other; that the size
of the four flagpoles is well scaled to the large facades, and their placement at the entrances do not overwhelm
this large building; that there is precedent for the presence of flagpoles on other buildings of similar scale and
institutional character; that their symmetrical placement flanking the entrances is typical of flagpoles on
institutional buildings; and that the cumulative effect of these changes did not detract from the special historic
and architectural character of the building and the historic district. Based on these findings, the Commission
determined the proposed work to be appropriate to the building and the historic district, and voted to approve it.
Certificate of Appropriateness 08-9731 is thus being issued.

Warning Letter 08/0640 is hereby rescinded with the issuance of this permit.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
