Auilo 187 W. 80 ST HDFC 187 West 80th Street New York, NY 10024 Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of February 12, 2008, following the Public Hearing of the same date, voted to approve the proposed work at the subject premises, as put forward in your application completed on February 12, 2008, and as you were informed in the Status Update Letter issued on February 12, 2008 (SUL 08-7335, LPC 08-0509). This approval will expire on February 12, 2014. The proposed work, as approved, consists of installing aluminum and wood storefront infill, with an anodized and painted black finish (Benjamin Moore Black Iron 2120-20); as shown in drawings LPC-1 through LPC-5 and LPC-3.2 dated July 7, 2007 and LPC-6 and LPC-7 dated February 7, 2008 and "Proposed Storefront Renovation" rendering, prepared by Garrett Singer Architect, PC, submitted as components of the application, and presented at the Public Hearing. The proposal as originally presented called for light aluminum and dark wood finishes. In reviewing this proposal, the Commission noted that the Upper West Side-Central Park West Historic District Designation Report describes 185 West 80th Street, aka 421 Amsterdam Avenue, as a Romanesque Revival style flats building with neo-Grec elements designed by Frederick T. Camp and built in 1887-88; and that the building's style, scale, materials and details are among the features that contribute to the special architectural and historic character of the Upper West Side-Central Park West Historic District. The Commission further noted that Notice of Violation 92-0359 was issued on May 29, 1992 for "the installation of shopfront, awning and signage without permits"; and that this Notice of Violation was issued for work at the storefront located at 421 Amsterdam Avenue. With regard to this proposal, the Commission found that the removal of the existing ground floor infill will eliminate modern elements which detract from the special historic and architectural character of the building, streetscape and historic district; that the design, details and finishes of the proposed storefront infill recall the configuration and proportion of the historic projecting storefront evident in historic photos and will blend harmoniously with the details of the building; that the proposed storefront will maintain both the storefront module created by the ground floor piers and the traditional transparency of the ground floor which are characteristic of storefronts within this historic district; that the painted finish will be in keeping with the painted finishes found on historic storefronts in this historic district; that the proposed retractable sloped canvas awning with open sides and a loose skirt is similar to traditional awnings found at buildings of this period in terms of size, shape, and materials; and that the proposed awning will be limited in length to the extent of the storefront and will be installed at the transom bar, and therefore will not mask the significant architectural features of the building. Based on these findings, the Commission determined that the proposed work is appropriate to the building and to the Upper West Side-Central Park West Historic District, and voted to approve this application. However, in voting to grant this approval, the Commission stipulated that the color of the aluminum framing be darker; that the materials, finishes and design of the bulkhead be restudied in consultation with staff; that probes should be done at the bulkhead to determine any existing historic fabric; and that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on April 4, 2008, staff inspected the probe at the bulkhead and determined that no historic or significant features remained. On April 22, 2008, the Landmarks Preservation Commission received paint samples and final revised drawings C-1, A-1, A-2, A-3, A4.1 and A-5 dated March 21, 2008 and A4.2 dated April 21, 2008, prepared by Garrett Matthew Singer, RA. Staff reviewed the drawings and found that the revisions recommended by the Commission have been incorporated and that work also included interior alterations at the ground floor storefront, including the demolition and construction of non-bearing partitions, finishes and fixtures; and plumbing and sprinkler work. With regard to the additional work, the Commission finds that the interior alterations will have no effect on the significant architectural features of the building and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 08-9415 is being issued. Please note that Notice of Violation 92-0359 remains in force against the property and is not addressed by this permit. Failure to address this Notice of Violation in a timely fashion will result in the issuance of a second Notice of Violation (NOV) originating from the Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7 02(c). This NOV would require a court appearance and a civil fine may be imposed. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
