Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of June 26, 2007, following the Public Hearing and Public Meeting of June
19, 2007, voted to approve a proposal for certain work at the subject premises, as put forward in your application
completed June 5, 2007, and as you were notified in Status Update Letter 08-0037, issued July 2, 2007. The
approval will expire June 26, 2013.


The work, as approved, consists of the removal of the entire rear masonry façade and the existing steel windows,
the scaling back of the building's footprint, and the installation of a multi-light metal and glass rear wall;
installation of opaque glass in the two (2) existing historic arch-headed multi-light one-over-one double-hung
windows at the secondary east elevation; the raising of the roofline at the rear portion of the building; and
excavation at the basement level. As initially proposed, the design called for the removal of the two arch-headed
historic windows at the secondary east elevation, and the closing of the masonry openings with brick. The
approved work was illustrated by a scaled model, and presentation boards that included photographs, and
drawings labeled 1 through 31, dated June 2007, prepared by David Chipperfield Architects, and presented at the
Public Hearing and Public Meetings.


In reviewing this proposal, the Commission noted that the Greenwich Village Historic District designation report
describes 12 Gay Street a Federal style house built in 1827-28; and that the building's scale, materials, and details
contribute to the special architectural and historic character of the Greenwich Village Historic District. The
Commission further noted that the rear of the building divides the interior of the block into two open spaces with
very distinct characteristics: one space is a very small rear yard directly behind the building, which is surrounded
by tall apartment buildings, and the other space is a larger courtyard just to the east, which is bounded by the
modest rear yards of extant federal rowhouses.

With regard to this proposal, the Commission found that the proposed alterations at the rear façade will not be
visible from any public thoroughfare; that the existing rear façade, which dates from the 1920's, has been
significantly altered and therefore its removal will not detract from the architectural character of the building or
the Greenwich Village Historic District; that a large portion of the side wall and the special arch-headed windows
will be retained, thereby preserving the distinctive courtyard space to the east; that the proposed decrease in the
size of the building's footprint, and corresponding increase in the size of the open space helps alleviate congestion
within this portion of the block, which is hemmed-in by tall apartment and loft buildings; that the proposed
multi-light glass façade at the rear will be a contemporary evocation of the existing multi-light artists' studio
skylights found throughout the historic district; and that the proposed change in the roofline will not be visible
from any public thoroughfare. Based on these findings, the Commission determined the proposed work to be
appropriate to the building and the Greenwich Village Historic District, and voted to approve the application.


The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two sets of signed and sealed Department of Building filing drawings showing the approved design.


Subsequently, on April 4, 2008, the Landmarks Preservation Commission received final drawings labeled A1
through A12, R1 through R11, R11A, R12, R12A, R13, R13A, R14, R15, and R16, dated 2/15/08, and prepared
by Manuel Castedo, R.A.; S-0 through S-11, SF-1, and SF-2, dated revised 2/5/08, and prepared by Gennady
Saratovsky, P.E.; and F0.0 (undated); F0.1, F0.2, F1.0, F1.1, F1.2, F1.3, F1.4, F1.5 (dated "issued to DOB"
3/3/08); M0.0 (undated); M1.0, M1.1, M1.2, M1.3, M1.4, M1.5, M2.1, M3.1, M4.1, M5.1, P1.0, P1.1, P1.2, P1.3,
P1.4, P1.5, and P2.1, dated "Issued to DOB" 2/25/08, all prepared by Andrew Sebor, P.E. Accordingly, staff
reviewed the drawings and found that they included additional work, including installation of a new skylight, a
mechanical enclosure, and an iron railing at the rear portion of the roof; and replacement of existing chimney
flues with new chimney flues. With regard to the additional work, the Commission found that none of the work
will be visible from a public thoroughfare; that the work will not damage or destroy any significant features of the
building; that the new flues will be the same height as the existing flues; that the additional work is keeping with
the spirit of the original approval, and that the proposal approved by the Commission has been maintained. Based
on these and the above findings, the drawings have been marked approved with a perforated seal, and Certificate
of Appropriateness 08-8688 is being issued.


PLEASE NOTE: The applicant is required to strictly adhere to the Department of Buildings TPPN 10/88
governing in-ground construction adjacent to historic buildings. It is the applicant's obligation at the time of
applying for their permit to inform the Department of Buildings that the TPPN applies.


PLEASE ALSO NOTE: This permit is being issued in conjunction with CNE 08-8730 for restorative work at the
primary facade.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
