Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 25, 2008, following the Public Hearing of the same date, voted to approve the proposed work at the subject premises, as put forward in your application completed on February 28, 2008, and as you were informed in the Status Update Letter issued on March 31, 2008 (SUL 08-8445, LPC 08-3076). This approval will expire on March 25, 2014. The proposed work, as approved, consists of constructing a rooftop addition, featuring steel framing and posts with aluminum windows and sliding glass walls and masonry clad in stucco, and creating new window openings in an existing bulkhead; as shown in staff site visit of mock-up; photographs of mock-up P-01, P-02 and P-03 dated March 12, 2008; P-04 dated March 14, 2008; and revised drawings D-101, A-101, A-301 and A-302 dated March 12, 2008, prepared by Michael Zenreich, AIA, Architect, submitted as components of the application, and presented at the Public Hearing. In reviewing this proposal, the Commission noted that the NoHo Historic District Designation Report describes 7 Bond Street as two Second Empire-style store, warehouse and factory buildings, one designed by Stephen D. Hatch and built in 1871, and the other designed by Griffith Thomas and built in 1872-73; and that the building's style, scale, materials and details are among the features that contribute to the special architectural and historic character of the NoHo Historic District. The Commission further noted that Notice of Violation 06-0216 was issued on December 9, 2005 for the "installation of pin-mounted letters at the fascia above eastern storefront without permit(s)" and Notice of Violation 07-0315 was issued on March 2, 2007 for "painting door red without permit(s)." With regard to this proposal, the Commission found that the construction of the rooftop addition, and creation of new window openings in the existing bulkhead will not cause the loss or damage of any significant protected architectural feature of the building; that the rooftop addition will not be visible in conjunction with the building's primary façade; that while the rooftop addition will be visible over the secondary side and rear façades of the building, from a distance at various points, it will be in keeping with typical historic rooftop accretions in the district in terms of its visibility and design; that the height, massing, and footprint of the proposed rooftop addition will not overwhelm the scale of the building; that the materials and details of the addition, featuring steel framing and posts with partially-glazed operable openings, will be in keeping with the character of rooftop accretions on adjacent buildings, and will allow it to blend unobtrusively with the roofscape; that the proposed window openings will be created at the secondary façades of an existing bulkhead, and will be only obliquely visible from the street, and will not detract from the significant architectural features of the building; that the placement of the new glazed openings will relate to the new rooftop addition with partially-glazed openings, and create a cohesive, modern design; and therefore, the proposed work will be harmonious with the special architectural and historic character of the NoHo Historic District. Based on these findings, the Commission determined that the proposed work is appropriate to the building and to the NoHo Historic District, and voted to approve this application. However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on April 1, 2008, the Landmarks Preservation Commission received final revised drawings D-101, A-101, A-301, A-302, A-501 and A-502 dated March 12, 2008, prepared by Michael Zenreich, RA; revised drawing S-1 dated February 11, 2008, prepared by Jack W. Mendelson, PE; and revised drawings H1.01, H2.01, H2.02, H3.01, H3.02, H6.01, FP1.01, FP2.01, FP3.01, FP3.02, P1.01, P2.01, P3.01 and P3.02 dated March 28, 2008, prepared by Matthew K. Bendix, PE. Staff reviewed the drawings and found that the work also included interior alterations at the sixth floor, including the demolition and construction of non-bearing partitions, finishes and fixtures; the installation of a new fireplace; the removal of four (4) existing HVAC units and the installation of four (4) new HVAC units; mechanical, plumbing, sprinkler and structural work; and the construction of a new stair to the roof; and exterior alterations at the non-visible roof, including the construction of a new stair bulkhead with skylights; the installation of four (4) operable skylights; the installation of a new wood deck and stone pavers; the installation of a new roofing system and roof framing; the installation of one (1) new condensing unit on top of new steel dunnage; and the installation of a new flue and vents. With regard to the additional work, the Commission finds, that in accordance with the provision of the Rules of the City of New York, Title 63, Section 2-19, that the proposed work at the roof consists solely of mechanical equipment; that it will not result in damage to, or demolition of, significant architectural features of the roof; that it will not be visible from a public thoroughfare; that it will not adversely affect significant architectural features of adjacent improvements; and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 08-9182 is being issued. Please note that Notices of Violation 06-0216 and 07-0315 remain in force against the property and are not addressed by this permit. Failure to address these Notices of Violation in a timely fashion will result in the issuances of second Notices of Violations (NOV) originating from the Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7 02(c). These NOVs would require a court appearance and a civil fine may be imposed. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or PAGE 2 Issued: 4/25/08 DOCKET: 08-7267 maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
