| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of January 22, 2008 following the Public Hearing of the same date, voted to approve a proposal for a one-story rooftop addition at the subject premises, as put forward in your application completed December 27, 2007. This approval will expire January 22, 2014. The proposed work, as approved, consists of the removal of the wood deck and planters, and the construction of a one-story rooftop addition with metal cladding setback 18-feet 2 ½ - inches from the Lispenard Street façade, featuring two (2) awning windows, three (3) fixed transoms, and one (1) sliding door at both the front and rear elevations; installing one (1) awning window on the east elevation; installing a rooftop deck on the new rooftop addition, with a 42-inch metal railing, planters, grille, one (1) skylight, and a spiral staircase at the front and rear elevations; installing a rooftop deck at the front and rear on the main roof; installing a covered walkway at the rear of the main roof; and extending the fire escape at the rear elevation up to the 6th floor; as shown in the presentation boards, showing existing condition photographs, an area map, color renderings, sightline studies, axonometric drawings, existing and proposed floor plans, roof plans, sections, and elevation drawings, all labeled D-101, D-102, A-101, A-102, A-301a, A-302, A-303, A-310, A-310a, A-311, A-311a, P-01, P-02, P-02a, "Photograph -F," "Photograph-G," "Photograph-H," "Photograph-I," P-03, and P-04, and submitted as components of the application, and presented at the Public Meeting and Public Hearing. The proposal, as initially presented to the Commission, consisted of a two-story rooftop addition. In reviewing this proposal, the Commission noted that the Tribeca East Historic District designation report describes 44 Lispenard Street as a Second Empire style store and loft building built in 1866-67; and that in terms of its style, scale, materials, and details it contributes to the special architectural and historic character of the Tribeca East Historic District. With regard to this proposal, the Commission found that the construction of the proposed rooftop addition will not result in any damage to, or demolition of, any significant architectural features of the roof; and that the presence of a one-story rooftop addition would not overwhelm the scale or character of the building, and would only be minimally visible from Canal Street against the backdrop of other rooftop additions. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Tribeca East Historic District, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that the two-story rooftop addition be reduced to one-story; and that two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on March 21, 2008, the Landmarks Preservation Commission received final drawings labeled Alteration Type-1, Z-101, D-101, D-102, A-101, A-102, A-301, A-302, A-303, A-513, and A-514, dated revised April 21, 2008, prepared by Michael Zenreich, R.A. Accordingly, staff reviewed the drawings and found that the change requested by the Commission has been incorporated into the proposal and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 08-8691 (LPC 08-7066) is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
